Hello Wonderful forum colleagues,

What happens if your permanent residency is revoked because of your frequent trips to abroad and staying longer than the allowable timeframe?

Can you go in for non-immigrant visa, say 5 yr multiple visa?


OR,

Assuming you dont want to become a permanent resident in the USA but you have the greencard, can u relinquish it and go in for a 5 yr multiple visa so u can spend your vacations in the US?

OR u will have problem getting a non-immigrant visa after giving up ur greencard?

Need your advice please.
 
This is a tough question....
I'm pretty sure you can't use your green card to come to the USA just for vacations.
Also, you will have trouble getting visitor non-immigrant visa after you had green card, unless you are really rich - if you show them you have tons of money in the bank, they will give you the visitor visa.
 
If you don't reside in the US and stay outside the country for more than a year or otherwise only travel there every now and then to maintain your status, you would risk being denied entry and have your green card confiscated at the port of entry. It's all at the discretion of the customs officer and it really depends on what you mean by "frequent trips".

If you have legitimate reasons for staying outside the country for a long time (e.g. to complete your studies), you may also apply for a reentry permit which will allow you to stay outside for 2 years without putting your permanent resident status at risk. Are you anywhere close to applying for citizenship?

You cannot "trade" your green card for a 5-year visa, but if you want to relinquish your permanent resident status, you can certainly do so by submitting an I-407 in which case you should not have any problems traveling into the US under VWP or a non-immigrant visa (if you qualify otherwise, of course).
 
What I learnt from this forum is that, you can go to the U.S and come back the same day if only you can make that possible after you have your green card but you must not stay for more than two months. I will suggest you only stay outside the State for such a long time after you have again your citizenship.
 
Depending on how long ago your GC is revoked, you should be able to ask for a reinstatement or appeal the decision. I think this is a good time to seek legal advice from an immigration lawyer. This is not something anyone here can answer and certainly we can't represent you in front of a judge.

There is usually a time frame from which you can appeal the decision before it becomes final, so if this just happened, you can't waste time. Good luck.
