Hi. Can anyone tell me what an employer does if they are transferring my h1b visa? I want to know the details what they send and where.

A major corporation recently offered me a job and they are transferring my h1b right now. They are saying if I do not get an I-94 attached to the documents that CIS send back, then I have to go back to home country and reapply visa and get a new I94 when arriving back to the US. Is this correct? and what is the chance for getting this outcome (going back home)?

To transfer the H1 -visa, you must be working with some company say A. when the new comapany say B, is transferring your H1, they will send your current I-94, and pay stubs (at least 2 consicutive latest). Then if BCIS approved your case, they will send you a new I-94 with new validity date. If you want the visa stamp, you must go to outside of US. However, your current visa stap will be valid until it expires. That means, even if you change employer, if you leave US for some reason, you can re-enter into US with your old visa stamp on pp.

what happens if they don't send I94 back? Does it mean transfer is rejected?

Actually, are they going to issue a new I797 with new I94 for a transfer?

You do not need send your original I-94 with your transfer papers. You have to send a copy of it.

Once your transfer got approved, you will get new notice 797.

The new I-94 is part of your new approval notice I -797.
