What happens to old LC?

Hi All,

I have an old LC pending with my current employer. I am thinking of asking my company to file form PERM. What happens to my old LC and my priority date? My H1B runs out in May 2006 but will get extension only on the basis of my old LC.

What is your old LC periority date. If it is 2-3 yrs old better convert into PERM. You will be the winner. But you need a good attorney.

The priority date is 24th March, 2005 and the H1B is expiring in Sept 2006. Could convert it to PERM and keep the old PD. What happens if my company applies for a new PERM.

If it is march 2005, go for new one.

If I dont convert (or conversion is rejected) what will happen to the previous PD? If I go to a new one, I'll lose my PD. Even if I get my PERM approved, I wont be able to renew my H1B in Sept 2006. Is it not?

You can renew your H1 based on your old LC pending thoeugh PERM is approved. But DOL cancel that LC then you have problem of having proof of LC pending more than 365 days

Thanks a lot. I am new to PERM and so I am asking so many silly questions.

Let us say that PERM gets approved on March 1st 2006. Let us assume that my 6th year H1B expires on May 31st 2006. Now, If I apply for I140 and I485 concurrently, will I still get to extend my H1B based on my PD with old LC which is March 2005.

Basically, what I am asking is this: If PERM gets approved, can I still ask for extension of my H1B after filing my I140 and I485 concurrently even though my I485 is not yet approved nor do I have my work permit.
