Hi,

I am not sure how the USCIS works for 485 processing.

I think they collect the application fees, ask for biometrics, and then the file sits on shelf until NC cleared.

Question is do the assign the case to the IO AFTER the NC is clear?

OR Do the assing the case to IO ONLY if NC IS Cleare **AND** the PD is current too?

OR
Do the first request the visa no. for the case and THEN assign the case to the IO??

THANKS

PD has to be current to have any further development on case.

Case gets assigned to IO who reviews if case papers are in order. If approvable then requests a visa number and after getting visa number approves the case.

Not necessarily true. Up until recently when dates were heavily retrogressed for India and China and some ROW categories, CIS had embarked on a scheme known as and widely pulicized as "pre-adjudication", where they adjudicated cases inspite of the non-availabilty of visa numbers. How else do you think they "approved" thousands of application within a few weeks in June/July. I know many friends who had got RFE's and indications from IO's that their cases are processed just waiting for the date to get current only to get their GC's approved when the date became current after many years this June.

That said, current trends do indicate that they are processing NC clear + PD current applications. This can only understate even more that USCIS changes policy on the fly to meet their service levels goals as well as other milestones.

Nothing in terms of when they should process I-485 is set as any administrative law or regulation leave alone statutory one, but fluid policies within USCIS.

Nothing is predictable in USCIS. My NC was cleared in Nov 2006, with my PD current as I am from ROW country. Still no update on the case. Details in the signature.

If you have not opened any Service request opne them now.
Send letter to Ombudsman
Talk to youir local congressman.

You have to keep the pressure on USCIS. You are ROW and should have been out much earlier since your name check got cleared so quickly.
