What evidence is required to bona fide married status?

Hello Experts,

I am in need of your advise.

USCIS has sent an RFE to my spouse, asking for more evidence to prove our marriage. Our attorney already sent our marriage certificate. We do not have any combined bank accounts or assets in our name and we live in 2 different address due to our jobs in 2 different states. I appreciate your advise on what other documents can be sent as evidence to prove our marriage?

You answered your own question. Your attorney should have advised you to establish those joint things before applying for the green card. Your green card is probably going to get denied.

Who is the immigrant, you or your spouse? Whichever of you is the immigrant, are you on H1B or L1 status? If yes, you or your spouse can stay in the US with that visa after the GC denial, and reapply later when you have established those joint documents.

Send joint tax returns for as long as you've been married. Also, you could send marriage pics, affidavits from parents and any other supporting doc that shows you two to be married. Don't fret. The difference in address is what that's triggered RFE, send some "secondary and tertiary evidence" like the ones mentioned to support the "primary evidence" i.e. marriage certificate and you should be good. Typically USCIS doesn't accept these secondary evidence docs but in case of an RFE and the fact that you already have a marriage certificate submitted, these should work.

Yes, I have submitted my lawyer with our Tax returns (married filing separately), my spouse's passport pages (which has my name in the spouse column) and our car insurance policies and whole lot of other evidences like marriage pictures (which spells out our name), marriage invitation, letter from employer, a sworn affidavit from my spouse, and my travel itinerary every week. I will appreciate your advise on any other primary/secondary/tertiary evidences that can be sent.
