What does this message mean?

This is what my lawyer wrote back

I got in touch with my lawyer with the LUD and this is what he wrote back--

" It appears to be a routine response to a customer inquiry. Usually, when it is a substantive RFE, the notice will explicitly state that.
The most recent NIW I-140 approval we received from Nebraska Service Center is LIN-0321******, filed on June 27, 2003. ------If that is any indication, there would be still several months to wait in your case. But be aware that the processing is not strictly according to the filing dates. It can vary significantly---------. -Just recently, we observed at our law firm two opposite extreme cases in I-485 processing. One case has been pending for nearly 3 years after its I-140 approval and still hasn't been processed, whileanother was approved on the same day with I-140 approval. Who can make sense out of that?"

FYI---his firm specialises in NIW cases. So all the stats he provide are for solely NIW.
 
My Mistake folks,

I have developed a tunnel vision cause of my own RFE issues. Submitted docs back to USCIS in response to a 485 RFE and have waited 14 weeks and nothing has happened. Have read that online message so many times that I can't interpret any other message as a non-RFE :)

Sorry again, if I confued this group. Does anyone here know for a 485-RFE (based out of Vermont), how long is the current "normal" time to wait after which one can conclude there is something amiss?....any info will be a great help.

In this case, the applicant communicated with USCIS, and this message is merely an acknowledgement of same. Messages for RFEs are quite different and clearly state that USCIS is requesting more information from the applicant.
 
Guys

I got a letter from NSC yesterday.The letter is dated 4/25/05. It says
" Your petition is awaiting officer review. We will make evry effort to complete your petition as soon as possible. If you have any further questions, please call----"
Seems like they havent yet touched my file :mad: What do you think I should do at this point? Is there any point in calling those guys back?

It is good you got a letter of consolation. However, the explanation given has no meaning. It goes without saying that each & every application/petition submitted is for officer(s) review and to take action. We dont expect them to pull applications from a bunny bag and send approval letters (although they may be doing that!).

I would suggest you to talk with your attorney and make him/her shoot a letter for further clarification and also to call them for the same and/or further progress, if any. Since, they have rolled over the dates beyond your RD, you have every right to bug them.

I totally agree with you, and I was really amazed to readthe letter yesterday. Not only are these people useless, they dont even seem to mind ADMITTING IT!!!!

I would like to talk to a NSC visa officer directly---any ideas about how to get hold of one bypassing the customer service people?

Call 800 number I forgot the instructions but mostly it is 1-2-6-2 check it. Actually go for application submitted and then in this option go for letter received from them for further evidence , here two options comes mostly it is 2... This will connect directly to NSC officer. Most important thing you talk as if you are petitioner or attorney on file. Do not talk as applicant!!!

Thanks for the input tjshah. I am actually the petitioner/applicant. So I guess that way I am OK.

Guys:

My LUD changed to 5/25/05 in the morning (both for I 140 and I 485). Will keep you updated on how it goes.
