Folks,

When my wife returned from India, immigration officer stamped her I-94 with paroled until 5/5/2001. What does that mean ? Do I have to get new AP before 5/5 ? Please help. Her passport was stamped at Newark, NJ. Thanks a lot guys.

I too had this question, since I will be travelling internationally over the next 2-3 months pretty extensively. My AP would expire by the end of June. Hopefully that should not cause any problems while coming back to the US.

Incidentally, what is the expiry date on your wife\'s AP ? Is it 5/5/01 ?

The expiry date was Nov, 2000. Will my wife be out of status after 5/5/01....what does it indicate ?Help guys....

Expiry date of November 2000 and your sife still travelled?
Are you sure about this? As far as I know, you should have an un-expired parole visa to travel while waiting for AOS.
I am not sure if your parole was valid during the travel? If your wife did not have a valid parole how was she allowed to enter the US?

No, My wife travelled in Feb00 to May00. When she came back on 5/5/00, officer stamped paroled until 5/5/01, is it because AP is valid for one year ? I still didn;t understand "paroled until 5/5/01" date ? -arms.

You should be fine then. Your wife will not be out of status after 5/5/01. Since you are in the AOS stage, there is nothing like a "OUT of STATUS" issue here. The advanced parole is valid for a year. May be that is the reason that the Immigration officer stamped the passport as mentioned.

However ever, if your wife wants to travel abroad again, you might want to consult your attorney. When you return back during the AOS stage, you should have a valid AP document from the INS. I am not sure if the stamping on I-94 will stand as against the actual parole document from the INS.

Any thoughts from the board guys......

TIA

I have been to India recently on AP and at the port of entry on return they stamped both the AP and I-94 as "Indefinite" beside the "valid until" lable.

However, that shouldn\'t be a problem as long as you are in the U.S.
