just looking for cummulative wisdom and advice about my situation...regarding a change of job.

ND 06/15/2001
FP august 2001

i am working as a physician in a small PA hospital who have never hired any one on H-1b and are not aware of details and pittfalls of immigration process. my lawyer handled all the paperwork....and i have been waiting 360 days since filling of AOS

my wife is moving to west virginia (VSC) for a residency and for family sake i want to move too...and most likely will find work as a physician there too....but it involves a change of address and change of state but same service centre.
also my job details are strightforward .....unlike most of techies on this forum....forntunately medical field has not seen any job losses either...also i am glad that my employers have no clue about immigration hassles and i am on good terms ..and leaving with required notice should not be a problem.

I appreciate any input from the wise ones as to how to proceed or not to proceed with my plan.

initially your ND freaked me out but I guess it is 6/2002, not 6/2001. You can change your job now and work on your EAD but there are two stipulations :
1) I485 not been processed by INS in 6 months
2) Job similar or same description as before
you are safe on these counts.

The risk for you is :
1) if you do not get a job soon after moving and INS RFE's you there could be a problem in employment based categories
2) salary >= LC salary (there is some debate around this)
3) Change in address can trigger RFE

sounds like you are pretty confident that you will get a job in the same salary bucket so you should be okay. You are, by no means, alone on this one. My two cents is that, the move will not hurt your chances of being approved, so go ahead and move after you get a job there. You cannot possibly keep your life on hold waiting for the INS god to smile on you.

On how to proceed, just move and file AR11 for change of address and then call BCIS to make sure your records are updated. Then be ready to answer a employement based RFE if it comes in the future.

thanks for reply ..my rd is 6/15/2002

how important it is to have the same salary as the initial job ...as i will be moving into hill-billy country with depressed economy ....

also does it matter if i submit my resignation as opposed to being layed off by the employer ...does ins question the motive if i am initiating termination of the sponsoring job .

do i need some document from present employer when i leave
