Hi There -

WOuld some one please tell me WHat is AC-140 ? How does attorney have to certify this ? Just send a covering letter attached to 140 package that was sent to INS ?

Once NVC sends packet III , do we have to send that back to NVC or we have to send it to consulate or Both for normal CP (Indicated in I-140).

AC-140 comes in picture if you haven\'t opted for Consular Processing in I-140 form. If you have already opted for CP, then your case will get created at NVC and packet III wll be sent to lawyer and Consulate. You need to fill the packet III and send to consulate to get the interview date and once interview date is assigned, you will get packet IV from consulate which you need to fill up and take it with you to the embassy
If you haven\'t opted for CP, then one possible way is to prepare the packet III yourself with the help of lawyer and sent it to consulate directly bypassing the NVC. But not all consulate accepts it and also they only accept it with I-824 receipt which needs to be filed stating your intent to do CP.
AC-140 is just a package of original I-140 approval notice along with the paper work used to file the application and with the cover letter stating the urgency to bypass the NVC by lawyer
