i am a us citizen i petitioned for my wife and on jan 3 2011 recieved a post desision letter,
i made 65k last 3 years for my taxes. i quit that job in december 2010 and now make 20k a year in a new job. i also got arrested pending felony charges. my wife is overseas,
1. how will the arrest affect my petition.
2.will my wife get an interview by herself since i cant travel out side of the us.
3.i used my taxes to sponser someone last year but that person turned out to be a fraud and is in usa illegaly beacause the petitioner returned the visa. is he still considered a dependent under me even though his visa was mailed and the petitioner returned it stating he turned out to be a fake

Your case seems to have huge boils which can pop at any time and create rash all over your body...:) What does the post-decision say? In terms of sponsoring another person last year, did you know this person was a fraud? Who it was? Your felony charges might or might NOT have a bearing on her petitions, unless you are convicted of eating another person alive, which could endanger your spouse (Prosecutor's view relayed to USCIS)...lol!!!

Your wife can attend the interview alone, you won't be required to be abroad. However, USCIS could ask her about your legal troubles and to what extent she is aware of your escapades here. You can use your tax return to sponsor your wife, as long as you meet poverty guidelines as established by your state, you will be fine. What this person whom you sponsored a family or friend? It might also be a good idea to invest in a consultation fee with a lawyer.

1. This only effects fiance visa petitioners. Irrelevant to you.

2. Virtually all Immigrant Visa interviews are only with the benficiary---they really don't wabnt the petitioner ther.

3. Check the I-864P for the minimum income for your household size (you, spouse, kids, other dependents on your taxes) at www.uscis.gov

1. It doesn't
2. It is normal for the interviews outside the US to be done with the immigrant spouse alone
3. Explain in more detail what you mean. Are you saying you filed an I-864 to pledge financial support for somebody else's green card process, but the petitioner returned the green card after it was issued?
