What can i do to get my RFE?

What can i do to get my RFE?nothing...just got it!!!!

My lawyer have not received my RFE due to wrong address. On 05/02, i called my lawyer and asked them to call USCIS but they said i should wait more so i decided myself on that same day to give USCIS a call.

They told me that only the lawyer can call to correct the address and ask the officer to send a copy of the RFE, then at the same day i got an email saying:

we responded to your request for more information concerning your case. If you have not received....

I am sure a response to this will be just a letter saying that my case is still pending, same old story :mad:

Today i called my lawyer and they told me that a letter was sent to me on 05/02, I know that!!!! :mad:, i explained to them that i had called USCIS and all, but to no avail, they told me to wait that USCIS does not like people calling all the time?

My question is, How can i solve this issue without the help of my lawyer? Is there any way i can get an inquiry going with the help of AILA without my lawyer? I am just not sure anymore what to do, especially knowing that RFE responses should be made within 90 days!Already used Senator for other issue but not yet congressman. As you can see my frustration just keeps getting stronger with all this but still hopeful my day will come ;)

Your lawyer seems to be highly incompetent. I do not think you can get in touch with an AILA rep directly. I believe only lawyers can do so. It might be an extreme step but you might want to think of switching lawyers. Not sure how that will solve this problem. You may want to consult Mr. Rajeev Khanna and his team for a solution. It might cost you some money but you really need to get this RFE situation resolved soon. Wish I could be of more help.

Thanks for your input. Regarding the incopetence of this person i have no doubts anymore, especially after learning so many things in this forum that my lawyer seems to be unaware of! shocking! It has always crossed my mind about switching lawyers but at this stage i am not sure if it would be a good idea, especially with the time frame to respond after an RFE.

What about a request to expedite?
Here's a cut & paste from the forum..

"Reason for Expedite Request:
1. The processing of my application has been delayed and at this moment is at least 6 months overdue. My RD is XXXX and your Service Center is processing March'04. Attached are the I485 receipts for self and spouse.
2. All outside checks have been completed. Attached is the confirmation from the FBI on the status of our record check.
3. After the processing date moved past my RD I initiated an official inquiry through my lawyer on XXXXXXXX and got a reply that I should hear something back in 30 days. No correspondence received after that.
4. The delay in adjudicating the petitions is causing me financial expense to apply for multiple EAD’s and Advance Paroles."

I think your reason is good enough to rrequest to expedite.

And another cut & paste of the format of request to expedite letter. OF course, change certain things to fit your case. e.g. VSC -> TSC.
Director name should be changed, too. Who's the director of TSC?

Thanks hanging in here, I will look into that. I am even thinking about the lawyer switch now as saras76 suggested,decisions...decisions...decisions... :)

You do not neccesarily have to switch lawyers. You can consult with some competent immigration law firm and they can guide you as to what your next steps should be. I am sure experienced lawyers have handled similar situations and will be able to tell you about your options. They will charge you a consulting fee but at this point I think its worth it. You can try Mr. Khannas firm or Sheela Murthy. Those are the two famous ones that I know of. I am sure there are lots of competent lawyers out there.

Got the RFE!!!!

GOD IS GREAT!!! :D

Surprisingly the call that i made to USCIS on 05/02/05 rendered some results! I just got a copy of the RFE mailed to my house!!(mailed out on 05/03) And also to my surprise they are only asking for a letter from my current employer!! This is so awesome!

I'm so glad you got your RFE. I had 2 RFEs last week and I was so nervous at first since I was not even familiar with the term. Thanks to this forum I learned that it is not a bad thing, "au contraire", it may push approval... (or so I hope)
Please keep us posted on your case. Hope you can respond to RFE very soon and get an email and case status changed to RFE received by next week!
