What BCIS is upto?

Hi All! It seems that BCIS is still processing the cases with "date of notice" in Sep-Oct 98. How come they have posted on their website that they would be processing cases with receipt date of nov. 99 and asked them to update their addresses.
I think that all they are doing is to keep AILA happy and under illusion that BCIS is moving the cases very fast. In reality it is otherwise. It is very fishy that BCIS is processing cases with receipt dates of oct.98 and nov.99 at the same time. There is a huge gap between these time periods.

What do you guys think?

I don't want to disappointed you but my RD is Sept 25 1998 and I just had my FP done last week and I don’t believe this is a final FP ( I had done already in 2001 once)

My RD was November 7, 1999 and just had my FP on August 27th.
I am not sure whats going on? I hope they are not categorizing further countrywise and so on.
 
I believe that they are just preparing for the next fiscal year. People with RDs from the second half of 99 should not expect final approval anytime soon, even if they have had FP done. This is my opinion.

They dont have why to keep AILA happy, and I dont think they care about that. They dont have to.
Being outsiders with no information about what is going on inside BCIS, it is hard to know what really is going on, and all we can do at this time is pure speculation.
Based on what BCIS has officially released, about a month ago, they have switch they workforce from working on employment based applications to asylum based cases.
We dont know exactly how many asylum based I-485 applications have been approved so far nor how many they need to approve to meet the 10k quota by the end of this FY. But they know that for sure. Because we dont know those figures all we can do now is just to speculate.
Bottom line is that, in my opinion, they are trying to do whatever is possible to get as close as possible to the 10 k quota.
 
A good possibility is that when this fiscal years ends in a few weeks they will switch back to employment based cases.

I think that everyone who's gotten a FP notice (i.e. cutoff date of 11/16) is under the fiscal year 2002-2003 Visa allocation. Please note that the fiscal year has nothing to do with approval date or processing timeframes. The only significance of the fiscal year from our perspective is the fact that BCIS has 10k Visas per fiscal year allocated for Asylee greencard adjudication.

I agree with the fact that BCIS is trying to use up all 10K visa numbers for 2002-2003 fiscal year. By sending people FP notices, BCIS can reserve and assign Visa Numbers to individuals. This way, the Visas aren't wasted - like they have been wasting them for the past 3 years.

Although approval for individuals who have recently taken their FPs will not happen before Sept. 30th, their Visa number will be reserved and not lost. Does this make sense?

In my opinion, its a good thing BCIS is doing this. Using all 10k Visa numbers will ensure nothing gets wasted. This in-turn will help increase the number of Asylees who get adjudicated.

That's my 2cents! Let's be patient. We've waited so long for this, sure we can wait a while longer.

I agree. Most likely they will start the new FY switching the majority of their workforce to EB, leaving only a limited number of officers working on asylum based applications. It is a logical approach.
Meanwhile, until the end of this FY, they are preparing the road (ie, asking FP, RFE, etc) for 'approvable' asylum based appplications, to expedite their approval during first half of next FY.
Again, I have no solid arguments to support this statement, and it is pure speculation, based on the scarce information released to public.

Key point here is to know how many AB applications they have approved this FY, up to date: 8,000; 9,000; 9,500? or how many more cases they can realistically approve before this FY ends. Who knows? We dont, they do know that.
And because they know that, they can plan how many FP, RFE they have to process in the following months, and they can schedule when their work force have to be switched from EB to AB and viceversa.
After that, everything else is pure speculation.
 
Unfortunately there is so such thing as "reserving" visa numbers. Visa numbers must be used during the fiscal year to which Congress assigns them. For FY 2003 adjustment numbers, the final approval must take place before 9/30/2003. There are only three weeks left. Do you really think they can process your case to conclusion in this short timeframe, especially since you have not even received a RFE (most people get of those)?

Also look at the number of asylum grants made in 1997 and 1998. Since almost all asylees apply for adjustment and are approved, they simply cannot accommodate so many adjustments this year and stay within the 10000 limit.
