** What are the rules while on H-1B visa? **

Hello,

My husband has just gotten his H-1B visa, and we are moving to the US in May, from Australia. I like to find out what the rules are on the H1B visa...

1. Is he allowed to make money on the stock market (day trading) here in Australia while he is working on his H1B visa in the US? And if so, which country would he pay tax in?

2. As his wife, I am coming in as a spouse on his visa, and I am not allowed to work in the US... Can I work as an internet consultant for an Australian company, and make my money in Australia while living in the US? I would basically just sit in front of a computer and work for the Australian company.

3. What are the rules on setting up a small business in the US, while on the H1B visa? Is it a total new process, or is it to an advantage that he already has the H1B visa?

4. What are the rules on making money from selling items on Ebay and such, while on a H1B visa. I am not talking about $20 a month profit... I am talking about thousands of $ a month profit from selling. Is that legal on the H1B visa as long as I pay tax on it?

I would be very thankful if someone could make this clear to me,

1. Yes. It is considered passive income
2. You wont be working in USA then...wink wink
3. Although there is no law preventing starting a business , indirectly a H1B is prevented from accepting compensation from anybody other than the H1 employer. To start a business, you (or spouse) better have a green card..
4. passive income. Dont circumvent IRS
