Hi there,

Can anyone please help me out with this question. I'm a 20 year old UK citizern, I;m looking to visit the USA for a holiday this summer. I was arressted and convicted last year for Deception. Although it was not a major crime and only resulted in Community Service. I have read any one who has a criminal record can not enter the USA through the VWP and must apply for a Visa. My question is , What are the chances of getting refused entry if i was to just book my holiday to LA and go without a Visa seems my country qualifies under the VWP?. Surley people come to the USA not knowing they need a visa if the have a criminal record, Any help would be great all these applications seem stupid.


Please any reply's or advise would be great.

I am sorry to be the bearer of bad news but I will share only what I know based on my own experiences, and what I learnt from doing research.

I had a criminal charge in 2001 but it will soon be dismissed because the defendant came forward and said he didn’t want to prosecute anymore.

I applied for a US visa last year and was rejected, largely based on the fact that I had a pending criminal matter. These people knew every detail about my case!

I regret I applied for a visa at that point when my case was still hanging, because in just a few days that charge against me will be history.

However, the US embassy doesn’t seem to care whether or not a charge or conviction was dismissed. The US does not recognize dismissals or pardons from other countries regarding criminal cases or convictions.
So, once you had a past criminal charge or conviction and once you apply for a US visa then you’re automatically put into their central computerized records and in some cases even forwarded to the FBI!

As soon as you appear at any border or port of entry in the US, you will be detected and if they still think you’re ineligible for a visa, you will be turned away.
When you apply for a US visa, they do detailed background checks on you, so there is no way you can escape it.

Although you’re from a visa waiver country, you’re still required to apply for a US visa solely because you had a past conviction.

I’ve been doing lots of research on this stuff online and I repeatedly called the US embassy in my country but they were unhelpful.

I am currently emailing immigration lawyers to find out if there is any chance or law that would allow me to enter the US in future.
It looks very challenging but I still have to keep trying.

how come then so many criminals from Rusia ,Albania ,Armenia ,Ukraina etc goes there in drowes ???? literaly thousands career criminal from those country entr US with no hassle what so ever ??? especialy Rusians who enter US in ten of thousands (about 90 % of them with "heavy criminal "records-i.e; homocide,drugs offenc etc.)
