The tourist visa grants a max of 6 months stay at a time (but the visa itself may be valid for up to 10 years). After being inside the US when the 6 months is close to expiration, one can apply for a 6-month extension, but those extensions are usually rejected.
And similar to the visa waiver, with a tourist visa one should spend more time inside the US than outside in order to reduce the risk of being refused entry or having the visa revoked. Any extended time inside the US should be followed by an extended time outside.
Unfortunately, they probably will refuse to grant the tourist visa, because the application asks about having a spouse or fiance living in the US. If she admits to the relationship, they're likely to refuse the visa; if she doesn't admit the relationship, it would look suspicious if you marry and file an I-130 after she claimed she didn't have a fiance.
Does she have a bachelor's degree or higher? That would open up options for a work visa.
No college degree unfortunately. She graduated high school then started college for one year and deferred. As for work experiences she has worked in hospitality back home as a bar tender, server and 3 years working reception at the sofitel chain of luxury hotels. She said one of her friends got a work visa doin similar but I can't find anywhere at says these sort of skills could be grounds for a work visa. I'm looking at every angle as pretty desperate to make it happen!
Were does someone look for h2b jobs from outside the USA? Also will there be any issues if she does get the h2b visa n job. Marries applies for the I-130 then once the h2b runs out just come visit on the vwp for no longer than 3 months at a time? At least that gives us a year less wait apart than before if it can be done??? actually just read that the h2b can be extended year after year for a max of 3 yrs or would they not extend for someone thats filed a I-130? also these are the sort of sites i was refering to above that offer h2b visas.
Obviously she leaves after the h2b. Will that ruin any chances of reentry once the h2b runs out? Also do u need to have the h2b job already lined up or can u get the visa and get a job when u get here? She told me off some website that does something similar from Australia and I said u could do either. Like a broker that charged a fee but didn't kno if it was a scam or not?
