Wearing a Wire

Can I bring a tape recorder (hide it) or wear a wire when we go for our interview? Is it legal? I want to have some proof in case the immigration officer says something stupid during the interview.

Well unless you are able to sneak it through the metal detector and screener (like the ones in the airport) without being notice?...

Plus even you can record it you can't demostrate that the voice is from an immigration officer which the only way is to compare the officer voice in person, that is record by a especialist and then the especialist in voice behavior and that stuff can say that the voice in your recorder is the same of that person. And you need actually a court order for that which must be base through a case in a court and that the judge agrees to include your voice record as part of your evidence against the USCIS.

Hmm, thanks for the reply. I'll bring my ipod then :)

oh dear....
To record a private conversation without the person's permission and without a warrant is a misdemeanor (which would look nice on your application for AOS and FBI background check).
Even if you could meet the burden for a warrant, that there is current ongoing criminal activity and the person who you are taping is involved, civillians are precluded from obtaining them.
If you are that worried about what the officer will say, hire a lawyer; (s)he'll be at least cheaper than a criminal defense attorney ;)

Depending on where you live, recording a conversation without the other person's knowledge or permission might be construed as invasion of privacy and in my opinion, you are asking for legal trouble if caught. In some states, especially California, tapping/recording a conversation without the other person's knowledge is illegal and would make the recording unacceptable if it is used as evidence against that person. If i were you, i would not be stupid and mess with something that would land myself in jeopardy. Besides, why would you want to do such a thing?

I just feel frustrated against a government agency that seems so arbitrary in it's life changing decisions. I'd like to hold them accountable for their ignorance if ignorance so happens to land on me.

I understand your frustration, but if your state makes it illegal to record conversations without permission, the recording is of no use to you and will not hold valid in the court of law. I can only tell you what you are getting yourself into, rest is upto you.

The notice itself clearly states that the interview is video taped. So I guess they also record voice too (may be). And it clearly says no recording devices are permitted. In case, Our good Lord forbids, something happens that you will go to court against them, then you can request the records that they have had during your specific interview.
Dont try to do something foolish, This is not a kidsplay! As Ari4U said we understand the frustration as each and everyone of us in here are going though the same anxiety/ tension. Hope I made myself clear without offensing you.

well, you still can bring your ipod to listen some music for relax yourself while waiting. but just don't record anything. you are not double-O-7.

good luck in your interview. if you think you have a normal / easy case, you should not have any worries about what the interviewer said. again, USCIS has full power to approve or deny the case; unlike the consulate officers in US embassies. They have to approve the case if all requirements are met.

Uhmmm well probably you should read this:

http://www.ilw.com/articles/2006,0323-ellis.shtm

Is not that they can't denied a case but they can put in on archives for long period of time and recommend revokation. So in general speaking is not a must.

Good luck,
