We Should All Know This About 2nd Fingerprints!

USCIS has up to 240 days to make a decision about your case after you have submitted 2nd set of fingerprints.!

My congressman's office just called me with USCIS rep online. I think i was a little rude but I was at work and so i was in a very bad position to speak. If you all remember, i was excited a few days ago because of my 2nd fingerprint notice. Well, the excitement was for nothing and this is my last straw. It was confirmed that my namecheck was already cleared. Yep, already cleared. However, there are three compartments to a background check. That has not cleared for me yet. I asked her if my second set of fingerprints are what they are waiting for and she said, NO< THEY HAVE UP TO 240 DAYS TO MAKE A DECISION AFTER THE 2ND SET OF FINGERPRINTS ARE SUBMITTED. Basically by taking the second set of fingerprints, we are saying, go ahead and keep lagging on my case, it's okay. I dont' need it done anyway. I am done. I am working on my documents. I have given them enough chances. I cannot take it anymore. Because of finances, i cannot afford to sue until December, so they have until then. IF my case is not done, i am suing. I know Maryland is tough but I am fed up, tired. DONE!

I am so sorry to read that, frustrated_alot.

I too have received a 2nd FP notice after 2 years in name check blackhole, and I was hoping that there was a light at the end of the tunnel. But I guess with your feedback, that is also now meaningless .....

Indeed frustrating .....

Good news for ppl with 2nd FP Notices

Jelibi and frustrated_alot,

I just saw postings from both of you and wanted to write to you immediately. I have some good news to share. All of a sudden, something told me today to call USCIS cust service to ask about my pending N-400 status. I requested to be transferred to the officer. The officer gave me this news and made my day and without wasting a single minute I wanted to share this news with you all & esp you two and whoever got 2nd FP notices. I was fingerprinted for the 2nd time last Tuesday, Sep 4th and guess what ? The officer told me that my interview letter was mailed yesterday & my interview date is Oct 10, almost a month from now.
I request you all, esp ppl with 2nd FP notices. Please stay in touch with customer service and hopefully you guys are few weeks away from your IL. Believe me the pain and this long wait will be over.
Let me know if I could be of any help.

Here is my timeline:

PD: April 2006
1st FP: May 2006
1st Interview Notice sent: End of Dec
Interview Date: Jan 2007
File was not transferred so I was sent home by the officer
2nd FP: Sep 4th 2007
2nd Interview Notice sent: Sep 11 2007
Interview date: Oct 10th 2007

Frustra,
Don't give up. The cust service people can give out random numbers to keep the US rep happy,so don't put much faith in the 240 days. A few months after FP call the agency if you haven't heard anything.

Atlanta_Brother,

Thank you so much for sharing that good news! Congratulations !!

Wish you all the best on your interview.

Do you know if this implies that your name check is completed or is that implied?

Thanks.

Jilebi,

My name check & finger prints were cleared early this year. I was told that there was one more USCIS check that was holding my case. I hope that's cleared by now. To be honest with you, I will believe only when I take my oath & have my naturalization certificate in my hands.

I am with Altanta_Brother. Same thing here. My name check is actually cleared but there are other checks holding up my case. At this point i really have no faith in USCIS's ability to fix this problem without additional help. Like i said, they have until December only becuase of finances then I will sue the pants or the background check of of them. I am done waiting.

Frustrated_alot, the alternative to waiting until December to save hard earned money to pay the lawyers would be use to the great resources of this forum and spend no more than $300 or so and file your own suit against USCIS. If you have an undergraduate degree and your English seems fine, you should not have a problem. Just read the top sticky thread on WOM here and you will see how easy it is to sue on your own.

frustrated_alot,

Let's wait until end of the month. By then you will be done with your 2nd set of finger prints and your new FP will be in the system too. I am pretty sure that you will get your IL hopefully in the first week of Oct since your FP is scheduled for the 19th of this month. I understand your frustration. Since you have waited that long, why not another few more weeks, not even a month. Hang in there my friend and we still don't get an IL for you, I will let you speak to this awesome attorney in Atlanta. He has been very accurate to what he says and do. You will be in good hands. Just be little more patient and call the cust service number at the end of the month to get an update.

Stay in touch.

I did my 2nd fingerprint on Aug. 27, before I go to fingerprint my lawyer said that she had asked USCIS and they had said the name check was clear, and an IO had told me earlier they would not fingerprint unless the case is ready to be approved.
I did the fingerprint and I got an Infopass for the same day of my fingerprint to be 100% sure that the name check was clear that is what I was told: " Your name check is not clear yet, I do not know why they are fingerprinting you again" I was shocked so I called the local senator office and they replied within a day: " Your name check is not cleared yet"
Now I do not know who to believe, and I have seen posts regarding different type of security checks, Sep-30 with be 3 years since I filed my application and I have had enough of this I am filing for WOM Oct-01, and I think it is worth every penny I pay the lawyer
I am just fed up!!

Ciao

That's a long wait

neright,

This is ridiculous. You have waited too long and plus you are not even getting the correct information regarding name check clearance. If it has been that long since you've filed your N-400 case, I don't see any point in waiting. If you need a good attorney, I can refer to you. He is in Atlanta. I don't know where are you, but I am sure he can help you to resolve your case. Let me know and all the best.
