You are really naive to think so. My case has been pending since July 2001. If they have one atom of care they would adjucate it.

Foreigners are considered a problem these days. It's a double blow. They think we are the reason why the tech industry salaries are stagnant. And they eye us with suspicion after sept 11. Green card is not a right, it's a privilege and they give it when they want. No one can get into the internals of the BCIS. Don't think any letters actually reach anyone. I've called many time and sent many letters and all I get is "pending". When I ask till when? It's been already 25 months. They say, till it's approved.
I really check my status online about once a week maximum. I"m continuing with my life as if I have the green card.

Again, my advice, concetrate more on having fun instead of worrying and getting frustrated. What should not worry about what we have no control of.

Your story should be interesting if you tell it. We are trying to change things through different things among them the Petition. There are a lot of other things planned. Possible lawsuit, Press, AILA, AILF, Congress, etc. Your are welcome to join any of these activities and push your case as well this way. I am not trying to give you advise but I have observed a wrong attitude among people, like giving up and just waiting. If I were you mu case would be in the Supreme Court by now. I do not know if you did anything besides monitoring your case but I strongly encourage you to do something. Contact the ACLU, for example.

Another thing: Are you sure your case is physically there or maybe it disappeared. Did you ever read that case in CA where thousands of applications were shreded overnight?
 
The main reason EB based 485 cases suffered most is because EB based applicants never united to fight. TPS applicants filed lawsuit and now VSC put their cases into highest priority. If you don't fight, you'll never get attention.
 
My story

My received date is 11/13/2001. I live in CA but my company is in NJ so my company attorney filed my I-485 in Vermont. I was asked to do the second fingerprint in Aug and finished it in Aug.6, 2003. I got another notice yesterday to do the fingerprint in Sept. I called the FBI and was told the result for the fingerprint on Aug. 6 has been sent you California Service Center. I don't know if I shall do it again. One thing for sure, my case was messed up again.... I tried to contact congressman or senetor. In my case who shall I contact? California senator or Vermont senetor? Thanks.

You are right, let's be united and voice our concerns. If illegals can why not law abiding taxing paying should not voice their concerns. Just rememeber that they don't even pay the application fees still they fight for their right or privilege whatever you call that.
 
BCIS is like firefighters, where has fire, they go and put it out.
If we sue them, we become "fire", and they have to clean our cases.

As a first step let us contact our lawyers or the company's lawyers and ask them about the AILA's attitude and whether they are willing to help. I have already done it and I will let you know..

Thanks for letting us know about your AILA contacts. That was an AILA press release. It carries very little weight. I opened another thread under VSC to first ask our lawyers and then see if they are willing to help us in more specific ways than a press release. I also saw AILA's Driver licence and 800 number complains. What we are trying to do here is contact the members first and see what they think.

It's a useless effort. Like I said, these days the BCIS has strict instructions: Security is #1, it doesn't matter how long an application takes. After they discovered they gave visas to dead terrorists, the BCIS decided that there will be no limits on how long an application can pend. When I call and ask why so long? They say, security checks backlogs. They would rather make an applicant wait 10 years but not face one more mistake. Speed is now a very low priority and asking them to speed it up is as asking them to ignore security.


On the other hand, delays are not because of backlogs in most cases. There is an implicit BCIS policy to delay immigrant petitions. It's mostly for demographic reasons. After all, a US citizen can sponsor his brother for a green card but his brother won't have a "visa number" for 10 years. BCIS has the ability to approve I-485 cases in 1 week. But imagine if they do so, the population of the US will increase dramatically (relatives getting relatives). The delays are a population control measure that isn't a coincidence. It's a secret policy of the US government. They can not declare it openly but they do practice it in reality.

So again I urge you to enjoy your free time instead of having too many sleepless nights on a matter that you will never be able to change.

My RD is 10/01/2001, so far have not heard anything from BCIS regarding my case, already filed for 3rd EAD and 2nd AP last week more money for so called cash starved BCIS.

Last month after calling NCSC got response that "my FP have expired and I was sent a notice, and should complete it in order to get my application processed" till now almost 8 weeks have elapsed, neither me nor my lawyer's office have received any 2nd FP notice.

All this wait and uncertainity is causing great stress and anxiety.
 
OK Here is my story. You guys can refotmat if you want.

Applied I-140 in feb 2002 and got approved in May 2002. Applied I-485 in May 2002. Company name got changed but TaxId same. According to my lawyer suggestion filed I-140 Amendment for company name change in July 2002. In May 2003(almost after 10 months) got RFE requesting that "provide legal doc to show company name change happend legally" .
RFE response replied and received by BCIS in the first week of June 2003.
In the 2 nd week of 2003 INS denied our approved I-140 stating that Employer try to substitute new Alien for the Labor Certification. Which in turn denied I-485 applied based on that approved I-140.
In the 4th week of June 2003 I-140 Amendment got Approved.

If you see sequence of events happend in my case in June 2003 and INS denial reason, it indicates they made error by considering I-140 Amendment as new I-140 petetion for another person.
so we filed MTR(Motion to Reopen) in July 2003.

This worrying soul waiting for update on this.
The worst part is me and my spouse are on EAD because my spouse finished 6 years on H-1 and though I have valid H-1 but I used AP to enter the country. Once I-485 denied within 6 months if no reply from INS we need find other legal status or leave the country.. Because of this BCIS error we are going thru tremendous pressure .. Lossed mental peace ...Lossed interest in everything...
