I have been a secret admirer of this forum.
I learned a lot....

I had my citizenship interview scheduled for Feb 12th.
But when I went to San Francisco (Sansome St.), the officer said that they have no idea where my file is. Therefore, they cannot interview me.
Go home..
We'll call you back.

Wow
I mean sh... happens
but can you imagine if I did something wrong. They would denied the application.

any comments on this..
should I call the representative??
any ideas??

thanks a million

Can you post your timeline? It will help the others to answer your questions if the others know how long you have been waiting.

They kept telling me they didn't have my file, little hints here and there. The day before my interview, they called to de-schedule as they did not have my file. I expressed my upset feelings. They accepted to not de-schedule my interview. In the interview, I noticed that my file was thick and lots of stickers. I asked the IO and he told me that this is my file as they have everything on me since I moved here.

What's your timeline? If you have been waiting a while you may file a WOM. Visit us in the lawsuit sticky. Start making Infopass to request your interview. Call USCIS and ask to speak to a 2nd level IO. Never believe what the first people will say - only speak to a 2nd lv IO.

Thanks for the responses
I called the customer service
spoke with 2nd level officer
and he told me i should be happy, millions of people would die to be in my shoes.
be happy and wait...
that was the 2nd level officer's response

wow
how do you know i am not happy?
and this 'happiness' is not the case.
the case is my file is lost, and trying to find it
dont need to hear your lecturing about being happy

anyway

what do you mean by the time line?
What is VOM?

thanks

The signature with dates most of us have :)

when did you apply? When did you get your FP

Sorry for that 2nd IO. I'm less than happy with the way they treated me, that's why I persist as much as I can
:)

applied sometime in October 08
they cashed the check October 17th, 08
Fingerprinted on November 19th, 08
InterView scheduled on Feb 12th, 09

thanks for your response
i will definitely fight for my case

Your timeline is pretty recent. What is your DO and processing times? If you are not outside of the processing times, I would write letters with your issues to your politicians. Keep track of everything as you might build your case for your WOM.

San Francisco is the district office
and what do you mean by the processing times?
How long they take to respond?
if this is the case, I dont have any problem with the speed
my concern is what will happen next since the file is not around

They are processing files from June 8, 2008.

This is not accurate. Here is Phoenix, they are processing March 08 and lots of people who applied summer and fall 08 had their interviews. I would wait until the processing times pass Oct 08 and then file your WOM.

I heard that if they don't find your file, they can't adjusticate your case. When I had hints that they lost my files I persisted. Because they have de-scheduled your interview due that they lost your file, I would start writing your DO, Senators, House of Representative and CIS Ombudsman.

Cregan Thanks for your response.

I called the USCIS again, second time.
this time 2nd level officer told me san francisco received the file a day after the scheduled interview date.
we apologize....
i dont know if he was telling the truth or not, hard to believe anything
i dont know if i should wait a week or so

I am working as a teacher. The school is very though..
and it is my first year. my school is draining me mentally, managing but difficult.
no power to deal with WOMs, CISs and like
And I am tried with immigration lawyers, two different lawyers didnt appear for my hearings. first for deportation case, second for the marriage interview.
But thanks to California Bar Association we got our money back, twice.
but it wasnt an easy route.
and i am so close to be done. why should i call a lawyer to push me over the finish line.

anyway
sorry to vent here
it is frustrating
because they set the rules
i dont like watching my life being played in front of these people.
lets get it done
sure i am thankful to everything.
but i play with the rules: pay taxes, be a good citizen (working on it), contribute to the community, pay the fees. yes to all of these.
USCIS made all these changes and they still fail.
I am telling all these to my American friends and wife, i became quite a party star with all these stories.

thanks a lot man
i'will prepare for the struggle once again.

I just had my interview there last week ... mailed n400 early oct.
They seemed pretty on the ball so I'm sure they will schedule you pretty efficiently now they have the file. I get the feeling that now the times are short and they moved to centralised processing this kind of thing may happen more.

Hopefully you've got the deportation case all disclosed and nailed down to their satisfaction? That is liable to get them a little more excited.

All they really do is compare you to the statutes requirements and I don't think there is that much grey area ... all they really do is go over your answers to all the questions on the form. I don't think they have a whole lot of discretionary power either way.

Good luck and hope you get a date soon.

It's tax season for me. Papers and stress, I know about those. It's upsetting they make us go through that.

I bugged 2nd IO so often, they knew my voice. I called often to make sure they would tell me consistent information.

The lawsuit sticky was very helpful. I did not hire a lawyer. The only thing my former lawyer would tell me is patience. I let him go. People in this forum are so helpful and encouraging. Lazycis is very knowledgable. I'm so thankful for all the help I received here
