Our heart is on fire for we need our wife and mother of US national stepson. I was born and raised in the USA heartland by natural US citizens. We have been married almost four years and in love for 8. My stepson needs his mother. I can stay here for 30 days with her and in time could run out of finances. We can’t leave her here. We have been reading about waiting a year and filling out forms for froms that beget more forms. I just want her on the plane to come home. We feel lost and anguished.
What can we do?

Its a frustrating ordeal, I am in about the same situation... waiting and more waiting but seems though theres much else to do. Good luck to you and us all.

So if you have a passport then that should work just fine?

So why do you need a visa if you have a passport?

If this is true or not I do not know.........

Hello,

It isn't clear in your post what your exact situation is. Do you hold a conditional GC now? Do you want to travel home (outside the USA) to visit relatives and then return? How long will you be gone? If you still have a conditional GC, when do you need to submit paperwork to remove the conditions?

First of all, if you are a GC holder - conditional or not - you can travel outside the USA and then re-enter the USA with your GC. My husband has a conditional GC. We are now in the process of gathering the paperwork to remove the conditions.

He had no problem traveling. He did not need any special "travel documents." Just his GC was sufficient. He did get a U.S. Passport in his country, since his was expired and he was afraid they would not admit him back into the USA without a current Passport.

However, before he left, I called Immigration Services and asked what he would need to re-enter the USA. They said that all he would need is his conditional GC and that he was free to travel as long as he was back here in time for submitting the paperwork and being present for a possible interview.

no green card

Dear Karen, thank you so much for your advice!
I am a US citizen and my wife does not have a green card.
She may of had one in 1991, but they used the wrong name.
I think we need to file a I-130. Because we have been married over 3 years. (she is abroad in Samoa) It IS not clear that we need I-486 with our I-130. The law office web site here says I-130 only. I am afraid to make a mistake and never get her back.
I may try and apply for a visitors visa. I found out that a Samoan
that wants to go on vacation to Hawaii needs fly to New Zealand for and Interview. All this stuff is driving me crazy! Then I guess we can file another form for travel while waiting for I-130.
