My company applied for EB3 labor in 2001 at VSC. It didn't get approve for over one year, so we filed another EB3 at NSC in 2002. The NSC got approved within 2 months.

Now, after my NSC got approved, we recieved an enquiry from my 2001(VSC) labor requesting some documents. Since I already had a new approved labor, my company didn't bother to reply to the request.

DO they automatically cancel it if we don't reply to their query??? CAN I SOMEHOW REVIVE that VSC Labor petition??? Can we give them excuse that we didn't recieve their query??

BOTTOMLINE: IS THERE ANY WAY AROUND?????

Now there is no labor in VSC. All are in backlog center. You cannot have the cake and eat it too.

BECs sent out letters asking lawyers if they want to continue processing labor apps or not. If they did not apply in time in affirmative most likely ur case is closed. Checkout the thread at

might help

THANKS "DAYS_Go_BY".
DO YOU KNOW WHICH "PARTICULAR" THREAD WILL HAVE MY ANSWER... ?? There are soo many of them?

If the document which was not replied was 45 day notice, it would result in case closure.

I am not aware of anyone successfully reopening a BEC case after 45 day letter was received and not replied.

You can check PBEC and DBEC threads and post your question there to see if it is possible.

Hope it helps.
