Dear Fellow GC Hunders,

I need your input on this one.

Here are my Stats :
EB2 - India
Labor Received Date : Oct 31st 2000, Labor Cleared : Feb 2001. :cool:
I-140 filed : Aug 16 2001, I-140 Cleared : Feb 2002. :)
1st Medical for my family: June 2002 ;)
I-485 filed : Sept 24 2002. :D
1st FP for myself: Dec 2003 :eek:
1st FP for my wife : Nov 2004 :eek:
1st RFE : Sept 21 2005 :eek:
2nd Medical for my family: Oct 7 2005 :(
2nd FP (CODE 3) for myself: Nov 19 2005 :mad:
2nd FP (CODE 1) for my wife : Jan 11 2006 :mad:


I raised an enquiry with USCIS on Dec 19 2005 about my status. As of that date (Per the Jan 06 visa news letter ) the Retrogation date moved to Jan 1st 2001 for India.
I knew that if they looked at my flie in December 05, they would tell me that the Visa Numbers were not available. But, i just received a mail today stating that my Status is Outside Processing Date. This was mailed out on Jan 19th.
One other issue is that my Filing Date indicated on the response letter was Sept 24 2002, which matches with the Date my 485 was filed.

I am a bit confused. Doesnt the retrogression date go by the date our LC was filed... Was the response from USCIS appropriate ?.....
I would definitely appreciate it if i can get a feedback on this.

The retrogression date goes by the PD of your LC. So, yes, according to current VISA bulletin, you should have a VISA number available now. You may want to send an 'Expedite request fax' to the USCIS.
