Was any body got approval for refiling or appealing the PERM denial case

No REply

My case was denied because of a Typo error.My attorney applied for a reconsider motion.There is no communication from DOL so far.I'm searching here to see if some could reply me regarding this..But so far non.Please let me know if you come to know.

Your attorney should have re-applied after 30 from the date of denial. Motion to reopen ur case takes much longer as DOL's respoinsiveness is very unpredictable.

Even now, your attorney can withdraw the reconsideration motion and refile a new PERM application after the 30-day waiting period.
 
2nd denial reason

I just got reason from DOL and it says The application indicates the job order was not placed with the SWA serving area of intended employment for a period of 30 days. I saw my input dates for ETA application it was 10/15/2005- 10/14/2008. But I am wondering a thing here why it didn't deny for the first time for the same reason even though the same dates were there in my first denial then why they didn't mention it in the denial letter, do they go one by one reason at a time? I would greatly appreciate it if you please tell me something about it.

I am not sure DOL's system has the capability yet to 'digest' job postings that are extending into the future. Obviously the dates you have posted are nonsense.

Thanks for your reply GC, i appreciate it, but can you tell me now what could be done at this stage of denial where i am standing right now, one more thing i really like to hear is that why it didn't deny for the first time for the same reason even though the same dates were there in my first denial ETA 9089 form then why they didn't mention it in the denial letter, do they go one by one reason at a time?


My case
MS in mechanical Engineering
position : design and FEA engineer
experience : 2years
catagory of filing : EB2
Denial : twice
1st denial reason : 1) wrong sunday dates input + alien beneficiary should meet the actual min req to perform the job
filed again with corrections on 24 jan 06 denied jan27---06
2nd denial reason: The application indicates the job order was not placed with the SWA serving area of intended employment for a period of 30 days.

Can anybody advise me on that what should i do now
