Hi, I am thinking of the near future, I will be having my interview for naturalization on the 30th of November. My questions are, after I become a us citizen (hopefully :)) what forms do I fill out for both of my parents. They are here illegaly since 18 years ago. so what forms? How much time? Do they have to go to mexico or can they adjust their status in the USA? Should I get a lawyer? Do they have to do a waiver for being in here illegaly? Any experience or knowledge will help. So about how much time will it take? any help please!!!!!!!!!!!!!!!!!! thanks

Were they inspected when they entered the US, or did they not go through an immigration checkpoint under their real identity when admitted? Even if they go to Mexico they might still be subject to a 10 year bar for uninspected entry and being out of status as well as unauthorized employment possibly. You need to provide more info in order to determine if they are eligible for relief under the LIFE act through grandfathering or there might be another technicality that can help them.

@ anderson24; thanks for the info but do I file the petition and visa first then the waiver or vice versa? Do you think I should hire an attorney since they entered illegally? Thanks

@ praxx; thanks also but they entered illegally and what is the life act. What are the requirements to file under it? What other info would you need to know? I got married here in the USA and filed the petition and it was approved, I filed for the visa then I had to go to my country of birth to the us consulate for the interview. I was told that I needed to file a waiver since I was here illegally for more than a year. So I did and I got approved then I got my visa and was able to come back. Would they have to go through something similar? Hoping their waiver gets approved of course. Unless they can file under an act right? Thanks again

Illegal entry is a tremendously huge problem for Mexicans. Before 2001 Mexicans used to be able to pay a $1000 fine to adjust status under the LIFE act after living 7 years in the US but in 2001 they permanently eliminated that but people to this day can AOS under it as long as they were grandfathered into it via a petition before May 2001. It's ghost is now known as 245i you may have heard of it. I'm not sure if you yourself entered illegaly and that's why you had to apply for a waiver? But it's my understanding that your parents may have to leave the US for 10 years before being allowed to re-enter simply because of the fact of this uninspected entry for which there is no waiver...I think?

Check the instructions for the i-601 form and it may tell you about the eligibility. Maybe someone here can clarify the situation much better than me.
