Want to apply EAD, but have some questions.

Hello all,

My husband and I both holding H1B and we filed 140/I485 in 04/2004, our 140 was approved, and we just wait for I485 now.my husband is primary applicant.

My H1B expires in 12/2006, and I want to change my job, instead doing transferring H1B (most employer don’t want do it for us ), I want to apply EAD, my questions are:

1. Is EAD best choice for me? Or do transferring H1B?

2. After I get EAD, my H1B will be invalid, right? Is it worth it?


3. After I get EAD, can I work for any company? I’m a programmer, can I work for none computer related jobs? or I have to stay in same job title?

---Since, you are the dependent you can use your EAD instead of H1, which is waste of money (from your pocket)

---Yes. Your H1 will be invalid. However, if at all, you wanted to, you can go back to your H1/H4 as you are dependent. However, Primary can’t go back to his H1 once s/he used their EAD.

---Using EAD, you can work for any company. You can switch jobs just like a GC holder, as you are a dependent. Primary can do only with AC21.
