Waiver for Government funded J-1

Hi everyone,

Was wondering whether you guys could help me with 'J-waiver' via no objection letter?

My J-program is fully funded by a US government agency (i.e. National Institute of Standards and Technology). I was given a 5-year J-visa stamp on my passport. This July 2007 will be my full two years in this program, and my DS-2019 will expire in July 2008. Is filing 'no objection letter' petition enough to get me a J-1 waiver? What are the typical persuasive reasons to give when filing this petition?

If I extend my DS-2019 for another 2 more years (which is the maximum no of years allowed), will this help my petition (as I can say that the reason for
my petition is that I need more time to do my research?).

what status do you plan to be in to continue your research?
Since you had US govt financing, a simple "but I want a waiver" will not do.

I need a waiver to waive the two-year foreign residence requirement, as I am in process of getting a green card via NIW.

You are absolutely right - since I have USG funding, a simple 'but I want a waiver' will not do. But, I came across in this forum that quite a number of people managed to get waivers although their programs were USG funded - which is very encouraging. However, this forum also made me awared that the favorable recommendation strongly depends on which USG agency. Was wondering whether you guys know any success cases related to National Institute of Standards and Technology?

I was thinking that to build a strong case, perhaps I need to have a good statement of reasons?

Now, the maximum no. of year for J-1 visa is 5 years. I have been in the program for nearly 2 years now and my DS-2019 will expire July 2008, therefore I still can renew it for another 3 more years. So, if I file for J-waiver petition now, will this put me in an unfavorable ground?? Should I renew it to the maximum? Or, it doesn's matter at all??
