Hi All,

One of my friend's had filed the 140 and 485 in the concurrent process. It has been about 8 months now.

The question is, in general, the people are asked to be with the company for about 6 months after filing the 485 (after the 140 is approved). where as in her case, does she need to wait for 6 months after the 140 approval or can she change companies with similar job immediately after the 140 is approved as it has been more than 6 months that her 485 is filed?

In this case she can change as soon as the I140 is approved. 180 days count from the receipt date of I485.

My case is little different. After my Labor is approved, I changed company. My old employer with whom my Labor is approved continued my GC process. Will there be any problems in approving my case? We got 2 RFE's on my I-140. One asking for Company financial statements and the other is how the company is going to supprt my employment after GC is approved. We replied few days back for the second RFE. If any one has similar experience please let me know. My 6 year term will be done by Nov 2004.

----No problem if you are qualified for AC21

----Depends on the lawyer how he argued or what papers for company financial statements attached

----- If the officer is statisfied with reply and documents he may approve I-140 after he gets RFE reply
When did you file I-140? Did you file I-140 and I-485 concurrent? Did they approve your EAD, AP and then sent the Rfe? What isYour service center?

MY service center is Texas. I filed concurrent for I-140 and 485. My I-140 RD date is 11/13/2003. I applied for EAD for me and my wife and both of us got EAD then we got the RFE on my I-140.

Ginnu, Could you please explain me if I am eligible for AC21.

My Labor is approved with company A in March 2002. I joined company B in April 2002. After joing compnay B we applied for I-140 and 485 with comapny A. I am at the same job location for the past 4 years and I joined company B for whom I was a contarcor from Comnay A. Please tell me if my case is qualified for AC21. Thanks in advance.

------ At this time you are NOT qualified for AC21 because your I-140 is NOT approved AND I-485 is not pending more than 180 days. You need I-140 to be approved AND I-485 pending more than 180 days
