Hi

Background: Came to the US on F1 / finished school / Started working on H1 (never left country to get it stamped).
Married to a USC. 130 and 765 approved. Waiting on AOS (485 approval) for last 6 months. Currently working on EAD (765)

Never out of status.

Question: Am considering travel abroad (hence want to apply for 131 - Advance parole). Is it safe to travel given this history?

Thanks bunch!

Yes. I'm sure you know that you are no longer in H-1B status since you're working on EAD, and therefore re-entry using AP is appropriate.

If you apply for AP now, don't expect to get it for 3 months. Have you already had your interview, or do you have your interview date yet? Unless you're stuck in name check, there's a good chance you should get your interview and approval within the 3 months (check immigration trackers for other applicants' time line at your DO). But, if you want to make sure you can travel, it would be prudent to apply for AP anyway just in case you get stuck in name check.
