Waiting for the packet to be sent from KCC to local USCIS

Hi everyone,

I already had an interview with the immigration officer for the adjustment of status for DV2006 over a month ago. The officer told me that everything is complete and there is no problem with my case except for one thing. He is waiting for a packet containing information about myself that is supposed to be sent by the KCC. Since he did not have that packet, he told me that he could not approve my case at that moment. He told me that he would order that packet from the KCC and he expected that it should take about 2-4 weeks to receive the packet and approve my case.

Since it has been over a month now, so I have a concern that he still has not received that packet from KCC. I sent an e-mail to KCC about the problem and they replied to me saying "KCC is not authorized to assist you with this issue"!!!!!

OH.. MY.. GOD..!! Does anyone ever have this kind of experience before? What should I do? What should I do?

Just wondering, I didn't mail the form DSP-122 to KCC and I just found out that some people did. I wonder if this might have anything to do with KCC not sending the packet to USCIS. Is there anyone who do the AOS and didn't mail DSP-122 to KCC but was approved for greencard anyway? Thanks!

Hey, if you trying to make adjustment at your local USCIS that you don't have to send these documents to KCC. You should take this packet of documents to your local USCIS ( Chicago) office, they will provide you with instructions what to do. It says on the instructions for applying for adjustment of status(if you read carefully).I'm actually going to do the same next week, already made an appointment in Chicago too.Good luck!
 
DSP-122 must be sent back

I would suggest you call KCC. Many people called KCC and KCC said they should send at least form DSP-122 back so KCC will know they want to do AOS. DSP-122 MUST be sent back to KCC. But call KCC to confirm.
 
I am in the same situation I didn't send the form DSP 122 to KCC. I called them twice over a month ago and they said it is not necessary to send it. Call KCC they will tell you all that you want to know. In my case they told me that my case was transfered to local office, but as you can see from my process I'm still waiting for the interview. You send the papers on the same month like me and yet you already had your interview. I had to wait almost 2 month for FP appointment. Good luck.
 
I have called them too, and got the same answer. You do not have to send the forms to KCC. I was told that once you send the payment to the dept of state they will know your intentions to do AOS. My guess would be that dept of state hasn't transfered their confirmation of payment yet and not the KCC.
But I remmember somone else had the same problem (probably Borya). Check the threads and Im sure there should be some better info in here.

P.S. I havent been participating for a while. Just want to congratulate all the applicants that succussfuly ended the process. Also congratulations to the 2007 winners. All 2007 winner check previous threads because there is tons of information to digest.

Does the AOS process depend on how soon you send your DV fee payment to PA?

Analit, I believe the fee payment to PA will get KCC to mail your file to USCIS. And your file is necessary for the immigration officer to approve your case in the final step. Other than that, I don't think it has anything else to do with AOS process.

Well, I guess Alincosma is right. Maybe I just have to be patient. But the thing is I just called KCC today and they told me that my file has already been sent to USCIS since March. I had an interview with the immigration officer in April and the officer said that he didn't have my file from KCC. I'm just afraid that my file has been lost in the mail or something.

So now I don't know if I should just wait or do something about it. And I don't know if the Infopass is going to help since the Infopass person is not an immigration officer and they can only answer general questions. Any thought?
 
If you make another infopass appointment ask to speak with an immigration officer, I did it and it help me a lot. They can check it and tell you what the problem is. Do you have all the clereances from FBI? As you can see other people have problems with that and it seems to be the major hold up.
Call KCC again, you'll speak with somebody else but who knows you'll get a different answer. It happened to me.

I sent DSP-122 back to KCC. It shows the applicant's intention to do AOS. I think, once they get it, they send the file to USCIS. Of course, the fee should be paid before you send your adjustment of status forms to USCIS. I just wanted to know if it matters how soon you pay the fee. It probably doesn't matter.

About your case: Doing something is better than just waiting, especially that you don't have much time. Go to the Immigration office, and find out what is going on. It would help if you get a confirmation e-mail from KCC about your file being sent to them.

After u send DSP-122 to KCC, they will send u another letter informing that they have transfered ur case to USCIS. I suggest everyone to send that form who do AOS because that's what they need and not to listen some damn lawyers who don't know anything.
 
Like I said before I called KCC twice and everytime they said that it isn't necessary to send that form. I had an infopass appointment over a month ago and talked to an immigration officer, she said that I don't have to submit that form.
Now I do not know why sometimes the system screws up, but these are the answers I got, when I found out about form DSP 122. I don't know how much good it will do to you if you send the form now, since your done with the case, and just waiting for confirmation , I guess , from KCC. Maybe they're checking visa availability for the region or country that you are coming from.

It's not required to send DSP-122, but it's much better. Simply if u don't send it, USCIS has to request ur file from KCC (they may forget) and it will take longer until they receive it.

I think you're right hmz but I also think that now it's to late to send it since the process is where it is. In my case to the KCC said that they send my info to local office. I can't believe that they can forget, but I do believe that the process is smothest. My case is a living proof.

One question, what form for Affidavid of Support do I need I-134-or the other I-867 .Thanks

It is I-134. (The other one, which is not for DV cases, is I-864)

I reviewed some of boryas postings and in one of them he said that in the third notice they required form I864 as Affidavid of Support, that is why I asked the question again.
 
For DV cases we use I-134.

P.S. In my interview letter they also asked to bring I-864 , but the thing is that the letter was based on marriage. Sometimes u gotta find out on urself what to bring.

My lawyer tells me that i dont need a affidavit of sup. but on that official site posted above I read:

So practically you should have one with you just in case. :rolleyes:

Well, good we had this discussion come up because I wouldn't have known. My process is taking long anyway, so I dont need any more delays (if the officer decides to require it).

I'll get one just in case. like somebody wrote in this forum, you don't want to go at the interview, be asked about the Affidavid of Support and go :eek:

Hi Guys,

What I understood abt I-134 it might requires for some and not for others.In general an imigration officer looks into it when they suspect the prospect immigrant might become a public funds liability(ask gov.for health or any other benefits right away).Someone with H1B with couple of year tax returns and some recent paystubs would give officer a general idea that this candidate is less likely to become a public charge.In this case he/she maynot ask for I-134.On contrary,someone on a student visa and with source of funds located overseas,they may ask for it.Also,some derivative beneficiary of H1B might also need to submit just a job offer instead of I-134.

Bottom line,if it is not a problem just have it with you just to avoid any delays.
