Waiting for interview, AC21 still needed?

Hi all,

Recently I was laid on 10/13/2004 by my previous employer who was the primary sponsor of my approved I-140, while our I-485 applications was pending. Our I-485 applications were filed on 6/15/2003 at BCIS - California Service Center.

On 10/20/2004 the current status of our I-485 were changed to as follows :

Current Status:

On October 19, 2004, we transferred your I485 Application to Register Permanent Residence or to Adjust Status to our office in SACRAMENTO, CA for them to schedule and conduct your interview. Scheduling can take several months. Our office in SACRAMENTO, CA will notify you when they schedule your interview or take other action on your case. If you need further information, please call the National Customer Service Center at (800) 375-5283.


I have since found a new job which is exactly the same kind of job I used to do with my previous employer though the salary is lesser for about 2K per year than with the salary when my I-140 was filed.

Questions :

1.) Do I still need to file for AC21 even though we're just now waiting for our interview appointment?

2.) If I still need to file one, where will I send it? Still to California Service Center in Laguna Nigel or to the local INS office here in Sacramento where my case was transferred to?

3.) Or can I simply just bring the AC21 letter during the interview?

4.) Will my lesser salary with my current employer, cause a problem in my AC21?

5.) Do I need to get a lawyer to draft the AC21 letters? Any recommendations, preferably someone with AC21 experience?

6.) What happens during the interview? Will documents be reviewed? Will my change of employer affect the approval of our AC21?

7.) Can our passports be stamped after the interview, assuming everything went fine?

8.) What sort of questions are asked during the interview?
 
Don't worry you are safe

It has been more than 180 days, just take letter for AC21 and recent paystubs. Pay and position shouldn't matter. Hire a competent attorney for AC21

----- once you get Interview date notice it will have time, date and officer info on it it can be officer A B C D, once you get that Interview date notice hire good lawyer and send AC21 letter with copy of your Interview date letter I-485 reciept, and write your name, DOB, A# copy of 3-4 recent pay stubs. it will save the time of Officer at the time of Interview OR you can take AC21 letter with you when you want to go for Interview. If you send letter to local USCIS after you recieve the Interview date to Invoke AC21 then better take two similar letters from your employer, send one before Interview date and take second letter when you go for Interview

--- they will send you list of documents to bring, you need W-2 for past 3 years, tax filing last 3 years, all EAD or I-94, AP, orignal birth certificate, Marriage certificates, passport and New Passport style 2 Photographs
7.) Can our passports be stamped after the interview, assuming everything went fine?
---- Yes, if no problem with name check or any documents missing

8.) What sort of questions are asked during the interview?
-- depends on the officer
