Waiting for i-130 outside the states

Hi all I'm a girl from the netherlands and i got married to an american guy last august..I flew back to my country which we consider a big mistake now....being apart is really hard on us. Now he wants to file the i-130 for me to get me there. Does anybody know how long the complete process will take till i can see him again? And is it usefull to apply for the spouse visa?:confused:

Vermont - for east coast

Both of them said it takes 6 months to process.


Applying for a Visa

An appointment package is sent to the agent or the applicant. (See note below.) The appointment package gives the applicant an interview date and tells you the specific requirements of the visa. It includes instructions on where to go to have the required medical examination. During the interview process, an ink-free, digital fingerprint scan will be taken. In general, the following is required:

A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States (unless country-specific agreements provide exemptions).
Birth certificate
Divorce or death certificate of any previous spouse
Marriage certificate
Police certificate from all places lived since age 16
Medical examination
Evidence of financial support. A completed Form I-864 Affidavit of Support from petitioner/ sponsor is required.
Application for Immigrant Visa and Alien Registration, Form DS-230, both Part I and Part II
Two immigrant visa photos
Proof of the marriage and the husband/wife relationship
Payment of immigrant processing fees, as explained below
An applicant may bring marriage photographs and other proof that the marriage is genuine. Documents in foreign languages should be translated. The consular officer may ask for more information.

Take clear, legible photocopies of civil documents, such as birth and marriage certificates, to the immigrant visa interview. Original documents can then be returned to you.

Note: The National Visa Center sends appointment packages to the agent for applicants in certain countries when the petitions are filed in the United States . The embassy or consulate sends appointment packages to applicants in all other countries. It also sends appointment packages to all applicants whose petitions are already at the embassy or consulate.

Consular Processing (CP) usually takes approx 8-12 months from filing the I-130.

You probably however want a K-3 visa, which would allow you to legally enter the US much sooner, then file for AOS once you are here. Maybe 2-3 months for the K-3, then 6-9 months for the I-485 once you get to the US.

Unlikely, because any immigration officer at a port of entry is likely to deny someone arriving in the country on a non-immigrant visa when they find out they are married to a USC.

Eligibility for a K-3 visa requires the I-130 to already have been filed. I suggest your husband gets the papers filed asap...

I am from Holland and we did th DCF,that means that we filed all the paperwork with the US embassy in Amsterdam.
The whole process took 28 days
