All,

My I-485 case was transferred to the Local office and they interviewed me for AOS a year ago and send my case for FBI name check. INS is yet to hear from FBI. Is there any body else waiting for so long after the interview for AOS?

Is there any thing that I can do about this? Please advise.

Only time FBI is involved is for FP. Are you from special registration requirement country? Did you know you have to reregister if you are from SR country?
Otherwise per freedom of information act, you can demand FBI, USCIS to produce the result/status of your case...

I do not think that FP stage is the only stage where FBI is involved. Are you aware of the new name check by FBI that was started in Nov. 2002?

I think you had mentioned about contacting FBI regarding the status of FP. That is not the issue I am having.

We are in the same boat. We have been waiting for 11 months since our interview.

Just received a notice for a 2nd fingerprint. Hoping that this will finally get us out of this mess.

I do not think that the second finger printing has anything to do with the FBI name check becasue INS does FP again when the first one expires and probably they(INS) send it to FBI as in the case of the first finger printing.

I am pretty sure about it becasue when I went to get advance parole to travel the officer did my second finger printing. It helped in saving some time. I did not have to make another trip. It was in July this year. I am presuming that the finger printing result would have come back already( I am not sure). My case is still pending as per INS as they are yet to hear from FBI regarding the name check.

My opinion is that the FBI name check has been completed in our case and the results sent back to the BCIS. Otherwise I don't see why BCIS would even examine the case and find out our fingerprints had expired. I would assume that the application would keep rotting on a shelf unless something came back from the FBI.

(Of course, this is what I hope has happened. If BCIS regularly keeps looking at applications for expired fingerprints irrespective of anything else, then of course you would be right)
 
Hi,

Yesterday I went to INS and checked the status of my second finger printing and learned that it is OK. Yet my 485 is pending because INS is waiting to hear from FBI regarding Name Check.

So I do not think that BCIS send notification for second FP after they hear from FBI reegarding Name Check.

Let us hope that some day soon FBI would send the Feedback.

I've been waiting for 7 and half months after interview pending CIA check ( as marked on our interview receipt). But information officer at Newark, NJ CIS office told us on Nov 4, 2003 (when 6 and half months had passed after our interview) that our cases are still pending FBI Name Check.

That means CIA checks have ended and FBI Name Check have started or they are just alias of the other?

I had my interview back in July, the officer told me that he is going to put my name for background check. Is that the same as FBI check?

also, I did not have receipt for the interview, I had a request for further evidence and 2nd fingure prints. So, my question is,

-when the officer at the interview says that he will put my name on the background check, does this mean long time of further wait?
- Does it mean that the case is basically approved, once my name is cleared?
 
If there is a name match with you know who, FBI triggers extensive review of your file. I am not sure (neither is USCIS) what procedure has to be taken to clear your "name" literally... I am not sure whether ACLU will be interested in your problem?

My answers to your two questions are "yes". Also your request for further evidence is just one of the routine statements which interview officer would put a check mark on for an appropriate one for each case after interview unless you got approval and stamp right on the spot, so I mean your further REF (actually first item on interview receipt) indicated that you indeed got your interview receipt.

Some people got CIA/FBI cleared in a short period of time after interview, some are still waiting one year after interview, and some got definite answers from interview officer that their CIA and/or FBI checks have cleared but need 2nd finger prints (which interview officers usually tell them the redoing finger prints only takes a matter of a few weeks for CIS to get results back, unlike CIA/FBI Name Checks). So I believe that how long you are going to wait for those check clearance depends on when the CIS actually put the checks on an order to CIA/FBI. I believe most of those who were interviewed have their checks' results back some time before their cases were transfered to local offices for interview. If your interview officer told you he would put you on FBI Name Check, that means he is going to do that rahter than before case transfer. The question is how soon he is going to do that, he may forget to do that after interview. So you'd better to check your status in person to prod them to move your case forward.

I believe none of the people including me who posted message under this thread got the FBI/CIA checks kicked off in Service Centers long before their date of case transfer, otherwise I cannot see any single reason for 8 months, 12 months, or even longer of wait for those clearance checks after interview. Remember that everyone has to get those clearance cleared before approval, which equally applies to all those non-transfered cases.

You might be right. It makes sense. But INS Local office never explains like this. So we really do not know for sure what is happening.

I had my interview on dec. 4 2002 and I got approved in october 2003 ( only after contacting a congressman several times..)
Last week I received a letter from the INS saying" welcome to the USA":rolleyes: and in the letter they said I will be receiving my plastic card within 3 weeks.
not bad after all...;)
 
Thanks for the feedback. I have been planning to contact the congressman. I thought it may not really do any good. I am wondering how you make sure that the congressman help you.

I am also going to try my luck that way.

Your best bet is to contact your Congressman or Senator. They will be able to help.

To calrify the INS/FBI interaction; the FBI gets involved in basically two levels:

1- when you submit your fingerprints, the prints are sent electronically and check against the FBI data base. Unlike what the IIO would tell you, this process actually takes just few days from the date of fingerprints. You can verify this from several threads on this forum. Mine and my wife's were cleared in the same day.

2- the FBI also gets involved when the INS performs the IBIS check (refered to sometimes as name check). This check actuall is done from the computer terminal at the local office or the service center. The officer types in your name and birth date, and the software generates few combinations (and the sound-like) of your first and last name and your birth date. The software then checkes those combinations against the data bases of the CIA, FBI, DOS, etc... This is where the name comes from Inter-agency Background Information System (IBIS). This process takes few minutes or hours. And is generally done right before or after the interview, and the qpproval is granted if things are cleared. However, sometimes you may have a lazy or busy officer, and would do it later.

The problem comes when there is a hit on your fingerprint, or name check. It doesnot mean that you have a criminal record. It only means that the computer has a possible matched with your name (or a sound-like). In this case, the corresponding agent (FBI, CIA, DOS, etc..) will have to do a more in depth search to find out whether you are the person on their system or not. Only very few will really match. This process may take few months since the INS will NOT check on the status of the check. They will just wait to get a response (God knows when).

The only way to move the INS is through the Congressional Liason, ALIA, or a strong attorney.

So do not waste time, look up your representative, and write a polite and clear letter explaining the situation.
