MY case has been transfered to local INS (san Jose)

"On April 2, 2003, we transferred your I485 Application to Register Permanent Residence or to Adjust Status to another BCIS office for them to schedule and conduct your interview. Scheduling can take several months. That office will notify you when they schedule your interview or take other action on your case"

Does any one know how much time does it takes for schedule an interview in San Jose.

Also can someone point me to SAN JOSe inteview thread.

any obvious reason why your case was transferred? My case is pending since long (oct 2001) and wondering if INS is transferring cases randomly or with some good reason.
 
I was expecting it as I have a misdemenor conviction under VC-31 (vehicle code 31) ie giving false information to officer on traffic accident.

Although I do not know what are the chances of approval with this?
 
user7, few reasons we have been able to identify.

1. If you explicitly declare you have belonged to at some time to some organization that is under INS blacklist (don't have that list).
2. Moved between service center jurisdictions due to job changes.
3. RFE response inappropriate.
4. IIO didn't get laid last night.

But I am all ears for what Sharma has to say.

Any arrest/conviction records.

Is anyone waiting for interview in SAN JOSE??
 
San Jose is pretty much faster than other centers and I have seen people are getting calls with in two months. If you don't have any criminal records then it should be fine. But as you are convicted under VC-31 then I don't know how you will make INS understand that what ever information you are providing to INS is true.

Most of the cases we have seen on this board are DUI ones.

Better to seek some good lawyer with you.

I just talked to my attorney. He is pretty much confident about the case as it is only offense and it does not fall under those moral turpitude etc. He will be representing me.

Do I need to look for Criminal Immigration attorneys or my current attorney will be fine. I have no complains so far with him.

According to him it may take somewhere 6-9 months he said we should expect the interview around October. Looks quite far to me with the knowledege that San Jose is quite FAST.

One more thing he mentioned that I should be expecting another finger print notice soon.

Any one waiting for the interview in SAN JOSE.
