W2's Issue

Is there any problem if i have w2 amount for the year
My I-140 got approved.
now i am waiting for my packet 3
tax returns for the years

2001- $32000
2002- $28000
2003- $55000

Is there any problem in CP if i have these Three years W2 's like this.

No doubt there is a big 90-100% difference between 2001/ 2002 W2 vs 2003 W2.

Is your current salary meeting your Labor certification mentioned salary? If yes then there may not be an issue!

Yes. my current salary meeting with the Salary mentioned in labor.
I have all the paystubs for this year and last year which will meet the labor salary currently.

I think you should be fine but just be ready to provide a valid and strong explanation as to why the same job in 2001 paid about $30000 and in 2003 paid $55000 if asked by the consular officer on the day of the interview!
 
W2'Issue

I have explanation like my wife was delivered baby in USA. So i took vacation in 2002 year.I hope this will be Ok. Isn't it. I am going to take a letter from my employer for the proof that i took vacation in the 2001 & 2002 year.

please suggest..

If that is the explanation make sure to carry your son/ daughters birth certificate which anyway is a required document for your cp interview although they may be US citizens.

Please help me also. in my case the w2's look like:
2000-$56000
2001-$61000
2002-$65000
2003-$70000
2004-$72000
its pay hike and promotion, job duties remaining the same.labor certification at $60,000

Do u think this may create problem in cp interview.

There should be no problem ...it is expected for individuals salary to grow with career and years of experience. So in your case it is normal and hence no issue!
 
W-2 & Taxes

This might not be the correct thread to ask this question, but anyway here goes.

My employer has paid the lawyer fees and all other filing fees, visa fees etc (for H1 as well as the GC) in the past, starting 2000. However, this year I received an amended W-2 form for all the previous years, that includes all the above amounts as salaries and wages (fringe benefits) paid to me. Now I have to pay taxes on these.

Has anyone else had a similar experience.

This appears to be a IRS question more than INS question.

I would start by asking your employer what his means and why an amended w-2? At least from yoru posting it is not clear! Also try posting details on one of the IRS Tax forum sites!

Hi all,
my H1 has started from october'2008.i worked on october and november/2008,i have a W2 for 2008 for 8.5K.
now from December 2008 to march 2009 i dont have a job(on bench),from april 2009 i am working...so for the W2 2009 i will be having only 31k(as i dont have a job for 4 Months).My labor is 50K.so i dont know when is the ideal time for stamping.

let me reiterate the w2's----

w2 2008----8.5k
w2 2009----31k(will be approximately,because of no job in 4 months)
Lca--------50K
i have all the paystubs latest but My w2 is less i.e;31k.

please give me suggestion on what is the better time...............
