Hi UN,
I have a concern Recd my 04 W2 and the Companys Name does not read the same :confused: as the one i am employed/ Petitioned for. The address is the same .Is this going to affect me ( In Case of RFE Regards to Ability to Pay or just W2 Rfe ) . Also if the tax ID # does not match the one on H1B ?GC APP is it a problem .Please advise.

How safe is it to change company Using AC21 after I140 Approval and 485 is pending more than 6 months ?
Can the COmpany still ask CIS to Revoke the i140 and Withdraw the 485?

With a approved 140 and crossing 180 days on your 485 filing, you are perfectly okay to change jobs using AC21. If you feel that your employer (who petitioned the 140) might revoke the 140, send in a AC21 letter with the new employer and you should be fine. The employer loses control on the approved 140 after 180 days. This has been outlined by USCIS in their memorandum too. I think you can check for this memo in murthy.com

Good Luck. You are absolutely okay to change jobs without the fear of your approved 140 being revoked.

By looking at this discussion and my previous W2, I think I might have a similar problem.

Here is my situation. For 2001 and 2002, my company's payroll was oursourced to Administaff, so all paycheck and the year-end W2s were issued from Administaff, and I can't find my company's name on them.

Is there a way to fix this? Really appreciate your opinion.
 
Our current paycheck is from ADP, which prints our company's name on that. But back in 2001 and 2002, when the company just started, the whole HR, including the payroll, medical benefit, 401K, everything was going through Administaff (http://www.administaff.com/index.asp). It was like on the HR side, I was employed by the Administaff. I received paychecks and W2s for my work in my company, but the W2 only has Administaff as the employer name, even the employer ID shown on my W2 was Administaff's.

On the other hand, all of my legal immigration papers, including H1, LC, 140, 485, are under my company's name.

Do you think this is a problem? What kind of documents right now I should ask for from my company or Administaff to prepare for REF, just in case?

thanks UN I found this link http://www.irs.gov/pub/irs-pdf/p529.pdf I guess it can be takesn under " Legal Fees Related to your job". i asked my Tax Consultant he said that not to take it till you get the green card once you get the GC he will reopen and file the expenses ( makes no sense anyways play safe rite )and of course it should be worth to Itemize it.

Hi UN,
My Lawyer spoke to the company regarding changing the W2 they said they may not be able to change the W2 but can give any letter saying that the company issuing the W2 and the company which sponsers Immigration belong to the same group of companys.

In your opinion will this satisfy the INS

thanks UN you are right as far ability to pay goes the company( Its a Staffing company) may be able to prove that since they employ around 1000-2000 people .BTW i got an RFE for my I140 last week dont know yet what they require lawyer still has to get mail.
