W2 Doesnot meet the salary Requirement

Hi!
Could you please post your views/experince becoz I'm really worried.

As per my designation and Labor laws I should get a Salary of $64K/annum. But for the year-2001, I've worked for only 5 months, rest of the time I was on Bench with no taxable income. So my W2 income was 26K. And for the Year-2002 my income was $23K, as I worked for only 4.5 months. This year I'm not in Bench and expecting to meet the Labor salary requirments.

Now my question is: If I get a RFE asking to submit my last 2 years (YR-2001 and 2002) W2s then will that be a problem, if I submit my above W2s? I want to be prepared before hands becoz I feel I may get a query anytime, as I've a very bad luck. Please guide me.
 
reply rfe with whatever you ahve and once you have GC join a new place and sue your old employer for not paying u full wages and reclaim all your wages.

Does anyone faced similar kind of Problem ? Is there any chance of rejecting I-485, if the salary requirements are not met ? Please post your experience. I'm very much worried.

I dont think u will get an RFE due to the salary differences, But anyway to address the point, I think if you are prepared with how you could mantain the status during the missing months that would really help.
You might not work because of many reasons, could be that you were out of the country to take care of someone, It could be that you yourself are not well. When you employer didnt put u on payroll for that much time, there is definitely something concrete that he might have prepared for. Think in his perspective and i think u will get the answers.

OK littlleluck ... looks like you have had a charmed life

without having to deal with "Bench" and other cool aspects of
the consulting bussiness..... Just kidding ..

Benching : When a consulting company keeps their employees on payrole while waiting for projects that they can assign the employees to. sometime some companies pay (very close to free money but with lots of tention) the employees while they are on Bench and some (Most ?) don't.

bcooler, thanks! for ur suggestion but I don't think that I can tell BCIS that Iwas out of the country for long becoz my I-94 won't show more than 6 weeks each year and I've to manage 6 months. Also I cannot tell any Medical reason becoz I never visited a doctor in past 5 years except for I-485 Medical Test.

If one find answer to my problem then please do post in this thread. I'm very much worried becoz if my I-485 is rejected then I've to go back to India, as my H1B is expired.
