1) LC - MS/BS+5 Approved, If I140-EB2 denied, can 140-EB3 be filed using the same LC.

2) I have seen postings where spatel70 and others have said that in these cases, EB3 can be applied using the same LC. Has anyone done this and has been successful.
3) If LC - MS/BS+5 Approved, then in order to avoid RFE and denials, can the person directly file I140 EB3 instead of I140 EB2.

1 you can apply two I140s one in Eb2 one in Eb3
2 you can apply in Eb2 and if they say they are not approving they will ask you to change it to eb2 AND THEN APPROVE IT.
