Visitor visa - questions (Please help)

If the consulate is Mumbai and any of your parent is above 60

According to the new rule in Mumbai Consulate if any one of the parents is above 60 years and son/daughter lives in USA, then the parents don't need to go for Interview they can use Drop Box facility and for Drop box I belive they will need only following documents from son/daughter side.

Passport pages (all) copies of son/daughter
Birth Cerificate of son/daughter
Green Card or Visa Copy
from there side they will need
application form
photos
drafts for application and visa issuance fee.

Thank you for your suggestion. I think, that is a good point.
I will just send them an invitation letter from my side and ask
them to produce other financial support documents. (My in-laws
do not speak Telgu.)
Any idea... how much bank balance (Indian rupees) my in-laws
have to show?
Also, Is it ok to mention on the visa form that they will be
staying with us?
I think my father-in-law is above 60 yrs, so he can take
advantage of drop-box. Right ?

I 134 Question

I need to sponser my in-law. In question 11 of form 134 should I check "Intend " or "do not intend" ?. Is it enough to check "do not intend" and send all the supporting docs. Any body please help

I think the whole idea of Affidavit of Support and providing all
other documents is that 'You Intend' to contribute something
to the persons visiting.Otherwise, what is the point of having a
sponsor?This is just my thought.You can mention whatever you
are going to contribute like one or more of the following:
room,board,travel expenses,medical expenses.

Sunnyk2002, I am not sure about how much bank balance your
in-laws have to show.I think enough balance to support your
in-laws trip.More the better. Because I think usually people will
produce I-134 from someone living in US and in that case they
usually concentrate on your ties to your home country.But here
since they don't have a sponsor they might look at your inlaws
documents closely.Take your best guess and see whatever
amount you can put in that account.

Can my wife sponsor the visitor visa for her parents?
In other words, Is it ok if my wife sends invitation letter along
with bank statements to show that she is willing to sponsor her
parents for the visitor visa (Note that she is not working, but she
has EAD) ?

A: Possibly yes, but since she's not working it becomes more difficult to convince an immigration officer. I say 'possibly yes' because she might be a joint account holder in your bank account, and assuming you can show a good amount of money in the bank it might be convincing enough to the officer. The most important thing is for your in-laws to show proof of ties to India to which they will return to after their visit to the US.

We will be showing a good amount of savings in our joint
account along with stocks and IRA account. Also, my wife has
brothers who are doing their own business in India, so my
inlaws can produce property letters that will show their ties
in India. Do you think sending copies of I-485 receipt and EAD
will help in getting the visitor visa ?

Once again I am giving my opinion......

If you look at affidavit of Support(I-134) for supporting evidence it says that
"The sponsor must submit, in duplicate, evidence of income
and resources, as appropriate"
I think your wife may be able to sponsor by just showing bank
balance to support her parent's trip(No idea how much this amount
should be).
And again I don't know anyone who tried to apply for visitor's visa
without sponsor.

Why don't you ask your in-laws to contact good travel agent in India and
ask them about how to get visitor's visa without having any
sponsorship?

My current status is I485-pending and my H-1B has expired in Jan 03. Do you mean, I still dont have to send a copy of my EAD or I-485 receipt? If yes, then

What is the proof to prove my current status?

Please refer the instructions for filing Form I-134 Affidavit of Support. I'm out of touch with the latest requirements. I don't remember sending copies of my H-1 when I sponsored my parents for their visitor's visa. You might want to check with people who have been sponsoring their parents/in-laws recently. If you need to show proof of status in the US then yes, you'll need to submit copies of your valid H-1 or 485 Receipt Notice. But if your have a valid H-1, your submitting 485 Receipt Notice and EAD won't help, that's what I meant.

I asked my inlaws to inquire about the visitor visa without a
Sponsorship. The travel agent told that a lot of self-sponsored
visitor visas are being rejected because of War. He suggested
getting the visitor visa through sponsorship. I am really worried.
I am going to try the option of the sponsorship by my wife.

On the form I-134 (Affidavit of Support), Section 8. "The following person named is wholly or partially dependent upon me"

what do I state here, My spouse and I both work so, does this section apply to us? or I just leave it as blank? Pl let me know....

I know its silly but I dont want to commit any mistakes. Thanks in advance
 
You should

include your spouse as partially dependent. That was how you probably included her/him in your GC processing.

But when I filed my Green card, My spouse was not working so it made sense showing him as dependent but now he is working and is not dependent on me....

Question: If I show him as partially dependent, I make like 45K, would it be ok to sponsor my parents - meaning on a low salary there would be like three dependents eventually. Pl correct me if I am wrong
 
Here I need a clarification, if one doesnt have a valid H1 or green card and if he is in EAD. What are the papers he has to submit for Visitors Visa I mean like 485 Receipt, EAD copy etc.

Advise from anyone is appreciated

Partially dependent means, the person listed has other sources of income.

Also, a "low salary" of 45K is not truly low per the US gov.

For a family of 2, if you show an income of $12,120, then you are eligible to apply for I-134 - Affidavit of Support. The 100% applies for I-134 (Non immigrant) and 125% applies for I-864 (immigrant).
