Visitor visa - questions (Please help)

Need help!!

- Applied for my I-485 in Nov'2001. Got EAD, AP.
- Recently got laid-off, actively looking for a job.
- We are expecting our baby soon, so wanted to call my in-laws
on a visitor visa. I am in a strange situation here and need your
help.
My questions are:
1. How can I call my in-laws on a visitor visa ? (I won't be able
to provide employment letter or paystubs because of my
job loss)
2. Can my in-laws apply for visitor visa on their own (i.e., without
the supporting document from me) ? In that case, What are
the documents required ?

Anybody in similar situation? Please share your experience.

Your in-laws can apply for visitor visa if they can show evidence of financial strength to support cost of living in the US, including air fare, medical insurance, living costs, etc.

You could send them a letter that says something like:

To whom it may concern:
This is to certify that I, <Your full name> of <City, State> is willing and able to sponsor <Names of In-Laws> for their trip to the United States. I undertake full responsibility for their travel costs to and from the US and for all their expenses during their stay in the US.

and bank statements. It's been a while since I submitted those documents. Refer http://travel.state.gov/visa;visitors.html

If you have any relatives here ask them if they can provide
required documents for sponsoring your in laws.Only people
close to you might be willing to do this because they have to
provide Affidavit of Support,Emp.Letter,Pay Checks,W2s,Letter
from bank etc.

You dont have to worry about anything, since you sending your papers to American Consulate in India ( they dont even bother to check your papers).

I sent my papers to my In-laws + couple of times to my parents.

So, dont think too much on this ... just send your papers. If you dont have ... thats Ok .... I am sure you know how to use MS-WORD

Also, The H1 visa stamp on my passport is valid until end of
May'03, So will that be a problem if I send the copy of my
passport ?

You don't need to send your passport copy to them. Just send them a letter as I mentioned earlier and consolidated bank statement(s). Assuming your in-laws are middle-aged or older, the Consular officer might not ask too many questions and might not even look at the documents you send. In my case, the documents that I had sent to my parents were never asked by the Mumbai Consulate.
 
In addition to the documents mentioned (Bank Statement and Invitation letter to In-Law's), You still need to send notarized copy of the Affidavit of support form I-131 and a cover letter addressing the American Consulate. These documents are sufficient to bring one on Visitor visa. Please note that you need to send separate Affidavits for each person visiting USA..

It's form I-134 and NOT I-131 (Application for Travel Document). Refer http://www.immigration.gov/graphics/formsfee/forms/i-134.htm for more information. However, since you cannot produce any employment letter this is out of question for you. That's why an invitation and bank statement are the only alternatives you have.
 
Sorry it is form I-134. Yes you are right Mavishka.. The form asks for the employer name and address... so This is ruled out..

Guys this is great support, and I belive helping each other will surely pay us back one day.

By Just reading the posts .. I got so much information that I will also be sending the following to my Father who is above 72years old and was refused the visa 2years ago.

I will send him the following ;

1, I-485 Receipt - copy
2, Last 3 Pay Stubs - copy
3, Employment/Service Letter - Original
4, Bank Statement for last 3 months - copy
5, I-134 - Original
6, Cover letter for US Counsulate .. Do not know what to write ?

Any suggestions ??
 
You need employment letter

Minimum requirements to sponsor is Affidavit of Support (I-134)
and as per its instructions you need following docs:
1. Letter from employer with start date,salary and whether
position is permanent or temporary and nature of employment.
2. Letter from Bank Current balance, date account opened and
amount deposited in last 12 months.

Since you cannot provide employment letter it is not possible for
you to sponsor.

Also if you are sponsoring wife and husband, only one I-134 is
sufficient and the form has a section where you write the person's
name you will be sponsoring and then you can added spouse's
name and upto 2 children in the same form. I have submitted only
one I-134 for my in-laws.
(Vijguy.I don't know if there is any change in rules recently.
When did you sponsor your...In other words when did you submit
2 affidavits for wife and husband. Did they ask for it?)

If you don't have another option may be they can try without
any sponsor by proving that they financially strong enough to
support their trip by submitting all property documents,bank
balance, statement from chartered accountant etc.
Maybe they can say that they are visiting for short period to visit
few places or to attend TANA (sometime in July in bay area) etc.

Last but not the least Standard Disclaimer.
I am not a lawyer. This is just my opinion.
Check with a lawyer or attorney or... etc.

Thank you so much for all the replies. This forum is great!

From all the replies here, I think my only option (Since I cannot
produce employment letter and paystubs) to try for visitor visa
for my in-laws is:

1. Send my in-laws an invitation letter and my bank statements
(as suggested by Mavishka).
2. Ask my in-laws to get all the property papers, bank statements
(to prove that they can support their trip without a sponsor)

I am little confused here...
If my in-laws can produce the financial documents (for their trip
expenses), then Do I need to mention in the invitation letter that
I will be taking care of their trip expenses ?
On the other hand.... If I send them an invitation letter (along with bank statements), stating that I will take care of their trip
expenses, do they need to produce any financial documents?

Please help me clear my confusion. :confused:

As I mentioned in my previous reply this is just my opinion

If your in-laws are going to provide enough documents that can
financially support their trip I don't think you need to send your
bank statements.Send them an invitation letter to visit USA and
also mention about TANA(If you'r in-laws mother tongue is telugu)
Your in-laws can tell at the embassy that they want to visit US
and they will pay for their trip. Who knows, may be this could be
a plus for your in-laws because for visitor's visa applicants must
prove that they have strong ties with their home country and
with this your in-laws can prove that they have property in India
and they have to go back to India to take care of this property.

how important are w-2's

hi guys,

how important are the W-2's, I have a pretty low w-2 from last year (13K), but i do have the current pay stubs (salary around 45K). Also any idea how much must be the bank balance to sponsor (parents/in-laws).

Would appreciate if anyone could help me on this.

You don't need to send them copies of your W-2 or paystubs. The employment letter should mention your annual salary. The amount to show in your bank statement is debatable. I guess any amount over $10K should be OK in my opinion.

I don't know what the latest requirements are for I-134, but in the past when I had sent those documents to sponsor my parents for a visitor's visa I had just sent the I-134, employment letter, invitation letter and bank statement.
