Visitor Visa for my sister

Hi,

I am planning to have my sister come to the US on a short visit, like 3 or 4 months. I would like to know if there is a possibility at all or how difficult it is and what do we need to substantiate her need to come to the US.

Thanks.

I am on H1B, stamping expired but have I-94 valid till July 2008. I am married and have 2 kids, my wife is a homemaker on H4.
My sister is also married in India and has 2 kids, both studying. Her husband is working there in a private concern.
Let me know if you need more info.

she needs to present an invitation letter from you to the US consul, detailing her itinerary and planned activities. it would help if you mention in the letter that you will provide a place and financial assistance for your sister while on vacation. the letter is not the sole guarantee for her to get a visa. she has to bring documents with her during the interview at the embassy to prove that she must come back to india. being married with kids is a plus. if she has several investments in india, that would also help. the key to get a tourist visa is to show to the consul that there is a very low probability for your sister to stay in the US. The consul doesn't have to know whether you have an expired H1 or your I-94 is valid. That is irrelevant to your sister's proof of coming back to India.

She has to overcome 214(b). If she can do that successfully, she will be issued a visa. You really think a 3 to 4 month visit should be called short?

Visa for my sister

Thanks..Ha ha yes it cannot be called short..and my sister is going to come alone to the US. Will that call for more questions by the consul officer?

they won't give her a visa THAT long. Try something more reasonable - two weeks, for example. Ok, three... But FOUR months!

That is not true. For as long as you have overcome 214(b) you can visit for as much as 6 months under a visitor visa.

You should, however, avoid such long stays as they make it harder for you to return and be granted free access again.
