Visitor visa applicant with immigrant petition onfile,pls HELP?

Hi,
My mother is going for B2 visa interview in Nov.This is her 2nd attempt.She had applied previously in 2004 and refused in 214(b).
This time we have sent letter to cancel her immigrant petition which was filed by her brother who is a US citizen in 2000.But we have not recd any cancellation receipt from USCIS.
Pleasecan anyone help and tell me whether my mother willbe able to get visitors visa this time.
PLS DO HELP ME I AM SO Desperate and TENSED.

Hi

Here is the problem

She had immigrant intent, a B visa is non immigrant intent

Maybe the reason she was denied is because


Section 214 of INA states

# Every applicant shall be deemed an immigrant until such times they prove to the consular officers satisfaction, they are not#


I would book appointment with congressperson, tell them the whole story, see if they will write a letter in support of B visa.


Unless she can prove she has strong, social, emotional and financial ties to home country then she will be denied

If visa is approived, third time lucky. This is only one step to entering into the USA

Should she get visa, the final decision to allow entry to the USA rests with officer at POE, no one else

If denied entry you are not allowed legal representation, unless you try to claim asylum

My son was denied a B visa as, family all LPR in USA so could not show strong family ties to homeland and never will be able to !
