My brother and sister-in-law got 10 years multiple entry visitor visas. They visited me couple of times and then in August 2008 my sister-in-law successfully changed her status from B to H1B. After that she never went back to her home country (India) and does not have H1 visa stamped. She is working, filed taxes and maintaining her status.
My brother did not change his status to H4 and uses the visitor visa for travel. In his last visit the officer at the port of entry questioned his frequent visits and only gave him 1 month entry stamp (I-94), he also wrote NO Change of Status, NO Adjustment of Status and NO Extension of Stay on I-94. Ultimately my brother has to leave within a month.
Now he is planning to go to the New Delhi consulate to apply for H4 visa.
My brother and his wife are married for last 10 years, their passport shows the evidence. Their marriage was court (registered) marriage so they do not have wedding ceremony pictures.
Do you guys see any issues with the stamping?
If the visa officer denies on any ground, what are the chances and rights they have to cancel his 10 years multiple entry visitor visa?
