Visiting India On OPT

I'm planning to visit India for 3 weeks in February 2011. Currently I'm working for a company as a contractor and I'm on OPT status. My OPT is getting to expire on July 9th 2011. I'm planning to apply H1B visa(premium Processing) after I come back from India probably by the end of February 2011.

My Concern is all about the risk while I'm coming back to US at Port Of Entry.. Because, by the time i return from India my OPT will expire with in 4 months (Expiring on July 9th 2011).

If any Immigration Officer at Port of Entry points out then How could I defend myself. I even heard that traveling with in 6 months of expiatory of Visa will have potential risk. My visa is getting to expire on July 15th 2011.

Is it suggestible to visit India?

8 CFR § 214.2 Special requirements for admission, extension, and maintenance of status.

(f) Students in colleges, universities, seminaries, conservatories, academic high schools, elementary schools, other academic institutions, and in language training programs

(13) Temporary absence from the United States of F–1 student granted employment authorization.

(i) A student returning from a temporary trip abroad with an unexpired off-campus employment authorization on his or her I–20 ID may resume employment only if the student is readmitted to attend the same school which granted the employment authorization.

(ii) An F–1 student who has an unexpired EAD issued for post-completion practical training and who is otherwise admissible may return to the United States to resume employment after a period of temporary absence. The EAD must be used in combination with an I–20 ID endorsed for reentry by the DSO within the last six months.
