Hi I am a Canadian Landed Immigrant, landed Canada 2 years back. I got an extension of 2 years and currently i am in US working in H1 B visa. I have to return to Canada before Dec 31st, 2002. My visa stamp in the passport is expired , but i have my new H1 B with me. Can i visit Canada and return US without the visa stamp in passport? Is the rule coming to effect on Dec 16th has anything to do with this? Please help me if you have any idea about this.
TIA.

But there is only 1 month left now. For stamping the visa in US, it will take 6-8 weeks, right?

Gknair,

Here's what I would do, if i were in your shoes. I would leave for Canada now. As long as the new law is not passed requiring BCC who are canadian landed immigrants from obtaining a visa, you shoul dbe able to come back into the US, without a visa stamp, since you have an approved H1-B (I-797). No the rule is not coming into effect on Dec 16th. Keep checking the US Consulate (Toronto) web site or the State Department's web site for more information about the VISA requirements for BCC.

When you go into Canada, do not drive a car with US plates.

Good Luck.

COuld anyone please tell me what the Hack will happened after December 16. Will the law change or it will remain the same as far as Visa concern for PR Canadian.

It is very hard for me to believe that Canadian Government is doing notihng to stop this new law fom implementing. How they can discriminate PR from citizen. Are the PR means nothing to Canada? Shame on Prime Minister of Canada and Canadian Goernment for not protecting canadians from these cruel Laws against normal Canadians.

Canada cannot force the US Government, and say that they cannot implement this law. All the Canadian govt. can do is protest it. If the US Govt. decides to do, it they will. No one can stop it. What's cruel about this law? Just get a stamp in the passport. One has to be afraid only when they have done something wrong. Morover the Government's will or do not make laws for our convenience.

One of my Brothers friends parents (who are citizens) were going to US and were refused. They are from India.

I am trying to find out what reason they gave for the refusal.
