Visa waiver overstay

My fiance came from Japan to US on 9-23 on a visa waiver. We will be married Dec 4. The plan was to file the immigration papers before the overstay deadline of about 12-23. (Is it 90 days or 3 months?). But we found out today that it might take 5 weeks to receive the marriage certificate, which is required for the green card application. That will result in a 1 or 2 week overstay.

If we don't get the marriage certificate in time, is there an extension form that can be filed so she remains "in status"? I imagine a week or two overstay isn't a big deal, but she's really nervous about it. We don't want to take any chances.

As long as the marriage was the result of a spur of the moment decision, do not worry about the 1-2 weeks of overstay.

I am trying to file my mother's GC (she is from Japan as well) while she is in the states (Adjustment of Status and cocurrent process) , too. But I will have to wait until I become a citizen, which she will be overstaying about 2 weeks I believe.

I am book marking your thread. Please keep me updated.

By the way, congratulations!
