I was a J-2 (two years rule) until last year, then I got my TN2 (Mexico) for a year (will expire Nov/2013) ... I work as a contractor and they just told me I am going to be moved to another company at the end of this month!
This means that my sponsor is going to change what is going to happens with my current TN-2 ? Can I get a new TN-2 with the sponsor from here in USA? do I have a grace period?

Thank you!!!

I'm not sure how you are beinbg "moved" to another comapny. If you are a contractor, YOU do the move, not your client. If you work for an agency, then the agency could have been your sponsor, instead of the client.

So, review you TN petition: if your agency was the sponsor, and you continue to work for that agency, then your TN is still good.
But if you are being sponsored directly by a client, and they are dropping you, then you need a new TN for the next client. No grace period.

F1 (OPT) to TN2 taxes

Hi,

So I will be on OPT from my F1 visa until June 30th, and then I will start my TN2 period (three years), as it was approved this past month.

I am wondering what kind of changes my employer should make in regards to tax withholdings - Right now, I get no medicare, or social security withheld from my paychecks. I am assuming that now those two will be withheld as soon as my TN2 period begins, but I'd like someone to tell me that is exactly the case.

Your assistance is appreciated!

The moment you switch -- or a re switched -- to TN, you are no longer exempt from Fica.

Note that if your TN had an I-94 attached to it, it *probably* took effect on the day it was sent. take a look at the expiry date. If it ends anytime before june 30th 2017, it means you are ALREADY in TN status, and should (a) fill out a new I-9 imediately, and (b) ensure that all pay periods since approval are accounted for for Fica purposes, which may mean collecting back a few periods.

Thank you for responding to my post!

That clears things out, great! and the I-94 attached with my TN2 approval papers shows that my status begins on July 1st, 2013. This is a link to a photograph I took of the same paper.

Again, Thanks!
