Here is my case.
I changed the company in Nov 2005 and last month I have got my new approval petition. My and my wife's current stamped visa has been expired. WE are planning to go to India in Sept on vacation and during our stay there we are also planning to get new H1 and H4 visa stamped. Meanwhile one company is applying for my wife's H1 in 2006 quota. Now if her H1 gets approved,
Question 1: Can she still travel to india in Sept and get H4 stamped and come back?
If yes,
Right now the interview dates in Mumbai consulate are available for Sept last week. I am trying to get one of those. But in case if we dont get in SEPT last week date and instead we get some OCT date
Question 2: Can we still stamp her H4 visa (as from 1st oct her status would be changed to H1) and travel to USA in Oct on H4.
Please let me know.
