Visa Revalidation

My H1B is valid till 2005. My visa stamp in the passport expired in oct 2002.

Question1. I am not planning any trips abroad till Dec. Can I get the revalidation done in India?
Question2. If the visa expired more than 12 months. Are there any legal issues eventhough I have a valid H1?

---- You can do it in India when you visit after December. You can also send your passport for Visa Revalidation in US, if you send now you may be able to get your passport back with visa stamp before December 2003(it is taking 10-12 weeks time) as your Visa stamp expired in Oct 2002 and you have not hit 1 year. Revalidating in US is better than being struck out side due to security checks and may have to personally go to consulate in India early morning and may have to get appointment for interview (new rules)

-- If you have valid I-94 and valid H1 approval notice you don’t have any problems. You can not get it Revalidated in US from Department of state if your past visa in passport expired 1 year back but you can get H1 visa stamp from your home country.

My visa stamping in the passport expired on October 1st,2002.
This was my previous company's visa.

I changed from Empoyer A to Employer B and visa transfer was done.

I did not stamp my current employer's visa in the passport which expired during June 2003. My current employer had applied for visa extension. But I have not got approvel yet. It looks like I might get by the end of September, 2003.

My question is, will I be able to send the papers to St.Louis for stamping before October 1st,2003. Or, by the time they start processing the papers, it might be well over one year. Will they reject in that case?

One Year - Is that the date difference between the visa expiry date in the passport and the date of receipt of packet at St.Lous [ OR ] is that the date difference between the visa expiry date in the passport and the date of processing our packet for stamping?


May I request you to please post replies on this.

Is there any website explaining this?
