I Worked for a company x from Aug 1999 to Dec 2001. During Sep 2001 company x applied for H1-B extension and got the approval . Meanwhile i left the company x and joined company y in Dec 2001. Company Y filed new H1-B and i got the H1-b approval for company y. In Jan 2003 i got an offer from company x (where i worked earlier). i came to know that it is leagal to work for company x with the old valid h1-b (filed by company x - company x h1-b is valid until DEC 2004 and company x did not cancel my h1-b when i left in DEC 2001).

my visa in my passport stamped through company y is going to expire in FEB 2003. I am planning to send it for revalidation with company x approval papers.

will there be any problems with the above situatuon?

No it is not legal to work for comapny X without a transfer or new visa application. Somebody is setting you on a trap.

I read FAQ in this site regarding my situation. also i consulted lawyer regading my case and my lawyer told me that it is legal to work with company x.

is it illegal to work for the company x?

what should i do now?

Hi

Plase read this FAQ posted in immigration.com site.

I transferred my VISA from Company 'A' to Company 'B' and after having worked with 'B' decide to return to 'A'. Is it possible to return back to 'A' and start working on the old VISA?

In case it can be done are there any legal procedures that i have to follow to return to 'A' in terms of adjusting my visa status again or whatever? Or can I start working with them right away just the way I was earlier.

In case I intend to return to company 'A' do they have to run a payroll for me in 'A'.

Answer: Yes. as long as company A has not revoked your H-1.
You can start right away. There are no legal procedures as far as immigration law is concerned.
Only after you join
