Visa Revalidation - Duplicate Passport

Hi Guys,

I have got a duplicate passport issued from Wash DC as my old passport had some stains on it. However, I did travel in and out of USA twice with my old passport with those stains without any hickups. The new passport issued does not have the H1 Stamp. My Visa on old Passport is valid until April 2005.

Now, I have changed my job and I have already received new H1 Approval Notice for my New Employer, which is valid until Aug 2006.

I need to travel abroad for business purpose for the client.

Question 1- Will there be any problems if I have 2 passports while reentering as, my New Passport does not have a Stamp, but the old one does (From my previous Employer)?

Question 2 - Can I get the revalidation done (for the new Employer) in the country which I am visiting? (Somewhere in Europe)

Question 3 - If I do not get the revalidation done, at the time of "ReEntry", will the Immigration Officer stamp the "Date" on I-94 based on my H1 Approval Notice or the Visa Stamp on my Old passport?

Question 4 - My Employer is preparing to file for I 140 & I 485. What impact this may have on my visit abroad and / or revalidation?

Any guidance will be highly appreciated. I know, I have asked too many questions, but Immigration is too mesmerizing for me.

No problems, just carry and present both passports. The visa in your old passport continues to be valid.

Most likely no, you have to be a resident in that country, not just visiting. Exceptions are Canada and Mexico. You don't need revalidation simply because you changed employers. The visa issued in the name of previous employer continues to be valid until expiration.

Your I-94 will be dated based on H1 approval, not visa. If your current passport is expiring BEFORE h1 approval notice date, the I-94 date will be limited to passport expiration.

No impact at all.

nkm-oct23 has replied to your other questions, just keep BOTH your passports stapled and carry Both the passports with you stapled( becase now both passport got married) :D
 
I appreciate the answers to my questions. Now, when I looked at my old passport, I see that Indian Embassy has stamped "Cancelled" on the first two pages while issuing me the new Passport. Can I still reenter USA on the basis on the Visa Stamp on my Old Passport if I carry the new passport stapled with the old one?
 
Yes you can, the old passport always carries the legend cancelled when a new one is issued.

Indian consulate cannot cancel the US visa only US can.
